ORDINANCE NO. 872
AN ORDINANCE VACATING A PORTION OF SOUTH EIGHTH STREET IN THE CITY OF GRAND JUNCTION, COLORADO.
WHEREAS, S. J. Miller Packing Company is the owner of property abutting upon the portion of South Eighth Street hereinafter described, and has requested the City to vacate the same; and
WHEREAS, the said portion of the street is not now used by the City and the City Council finds and determines that a vacation thereof will not cause any injury to the public and will be to the best interests of the City of Grand Junction and the citizens thereof;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION:
Section 1. That the following described portion of South Eighth Street, to-wit:
Beginning at the Northeast corner of Lot 5, Block 11 of Milldale Subdivision in the City of Grand Junction, Colorado, thence South to the Southeast corner of Lot 10 of said Block 11, thence East 15 feet, thence North to the Southerly line of that portion of South Eighth Street that was vacated by Ordinance No. 676, which Ordinance was passed and adopted the 15th day of November, 1944, and a certified copy of which was recorded March 28, 1947, in Book 462 at Page 183 of the records of Mesa County, Colorado, thence Westerly along the Southerly line of said vacated portion of South Eighth Street to the point of beginning.
shall be and the same is hereby vacated, subject to right of way easements upon, under and across the north 51 1/2 feet thereof for the construction, operation and maintenance of water, sewer, power, gas and other public utility lines and of a railroad spur track and that fee title to that portion so vacated shall be deemed and taken to vest in the owner of the property abutting upon the portion so vacated, subject to such easements.

I HEREBY CERTIFY that the foregoing ordinance, being Ordinance No. 872 was introduced, read and ordered published by the City Council of the City of Grand Junction, Colorado, at a regular meeting of said body held on the 4th day of March, 1953, and that the same was published in The Daily Sentinel, a newspaper published and in general circulation in said City at least ten days before its final passage.
