ORDINANCE NO. 873

 

AN ORDINANCE AMENDING SECTION 1 OF CHAPTER 51 OF THE 1952 COMPILED ORDINANCES OF THE CITY OF GRAND JUNCTION (BEING SECTION 8 OF ORDINANCE NO. 722), CONCERNING MISCELLANEOUS LICENSES.

 

 WHEREAS, it is the opinion and finding of the City Council that the general health, safety and welfare of the residents of the City of Grand Junction requires the amendments hereinafter set forth.

 

 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:

 

 Section 1. Subsections (6), (8) (a) and (b) and (9) of Section 1 of Chapter 51 of the 1952 Compiled Ordinances of the City of Grand Junction (being Subsections 8, 10 (a) and (b) and 11 of Section 8 of Ordinance No. 722), shall be and are hereby amended to read as follows:

 

 (6) Merry-go-rounds, ferris wheels and other mechanical rides or other amusements, including those customarily a part of a carnival, the sum of Ten Dollars ($10.00) for each mechanical ride or amusement for the first day of operation of such ride or amusement and the sum of Five Dollars ($5.00) for each day of operation thereafter. Other provisions of this ordinance to the contrary notwithstanding, for each concession, booth or stand accompanying a carnival the sum of Five Dollars ($5.00) on the first day of operation and the sum of Two and 50/100 Dollars ($2.50) for each day of operation thereafter.

 

 (8) Circus menageries or circuses and menageries or trained animal shows under canvas shall pay license fees as follows:

 

 (a) One ring, Seventy-five Dollars ($75.00) per day; Two rings, One Hundred Fifty Dollars ($150.00) per day; Three rings, or more, Two Hundred Twenty-five Dollars ($225.00) per day.

 

 (b) For each side show or traveling exhibition accompanying any of the above mentioned shows (whether under the same management or not), the sum of Fifteen Dollars ($15.00) per day for each side show or exhibition. In those instances when more than one side show or traveling exhibition is exhibited or shown under one canvas tent or other structure, the sum of Fifteen Dollars ($15.00) for each side show or exhibition shown under such canvas tent or other structure. Provided, that when more than five side shows or exhibitions are shown under one canvas tent or other structure, the license fee shall be Seventy-five ($75.00) per day for all shows or exhibitions shown under such canvas tent or other structure.

 

 (9) For each traveling theatrical, vaudeville and other entertainment, Twenty Dollars ($20.00) per day where one performance is to be given each day, and Five Dollars ($5.00) for each additional performance given on any particular day.

 

 Section 2. Section 1, Chapter 51 of the 1952 Compiled Ordinances of the City of Grand Junction (being Section 8 of the Ordinance No. 722), shall be and is hereby further amended by adding thereto as follows:

 

 (10) No license provided for in foregoing Subsection (6) of this Section 1, Chapter 51 1952 Compiled Ordinances, shall be issued to any person, association, or corporation, unless the activity for which the license is issued is sponsored by a charitable, benevolent or other non-profit corporation or organization located in the City of Grand Junction.

 

 (11) No license provided for in this Section 1, Chapter 51, 1952 Compiled Ordinances, and its subdivisions, shall be issued to any person, association or corporation unless and until such person, association or corporation shall make arrangements, which shall be approved by the City Manager of Grand Junction, properly to police, maintain and supervise the licensed activity.
