ORDINANCE NO. 874

 

AN ORDINANCE ANNEXING TERRITORY TO THE CITY OF GRAND JUNCTION

 

 WHEREAS, a Petition to annex the property hereinafter described to the City of Grand Junction, Colorado, was filed with the City Clerk and considered by the City Council on April 1, 1953; and

 

 WHEREAS, the said City Council at that time found the said territory to be eligible for annexation, the Petition to be signed by the required number of landowners, and all other requirements of Section 2 of Chapter 314, Session Laws of Colorado, 1947, to be satisfactorily complied with; and

 

 WHEREAS, the City Council did accept and approve the said Petition for annexation by its Resolution dated April 1, 1953; and

 

 WHEREAS, Notice of the filing of said Petition has been published once each week for four publications in the Daily Sentinel, the first publication being on April 6, 1953, and the last publication being on April 27, 1953; and

 

 WHEREAS, thirty days have elapsed after the first publication of said Notice and no Counter-Petition or written objection to the said annexation has been filed with the City Clerk of the City of Grand Junction;

 

 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:

 

 That the said annexation is approved and that the following described property shall be and it is hereby declared to be annexed to the City of Grand Junction, Colorado:

 

Beginning at a point on the South line of the S1/4 SW1/4 NW1/4 of Section 11, Township 1 South, Range 1 West, Ute Meridian, 679.8 feet East of the Southwest corner of said S1/4 SW1/4 NW1/4 of Section 11, thence East 151 feet, thence North 68o 45' East 115.3 feet, thence East 380.9 feet to a point on the East line of said S1/4 SW1/4 NW1/4 of Section 11, 326 feet North of the Southeast corner of said S1/4 SW1/4 NW1/4 of Section 11, thence South along the East line of said S1/4 SW1/4 NW1/4 of Section 11 to the Southeast corner of said S1/4 SW1/4 NW1/4, thence West along the South line of said S1/4 SW1/4 NW1/4 to the point of beginning;

 

 Due to the fact that the property owners are desirous of obtaining water and sewerage, the City Council is of the opinion, and it hereby finds, determines and declares that this Ordinance is necessary for the preservation of the public peace, health and safety, and that a special emergency exists, and it shall become effective upon its passage.

 

 Passed and adopted this 20th day of May, 1953.
