ORDINANCE NO. 906

AN ORDINANCE AMENDING SECTION 6 OF CHAPTER 80 OF THE 1953 COMPILED ORDINANCES OF THE CITY OF GRAND JUNCTION, COLORADO, AND PROVIDING FOR THE DEDICATION TO THE CITY OF LAND IN NEW SUBDIVISIONS FOR PARKS, PLAYGROUNDS, SCHOOL, RECREATIONAL, FIRE PROTECTION OR SIMILAR PUBLIC PURPOSES.

 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:

 Section 1. The last paragraph, entitled "land required for other public purposes" of Section 6 of Chapter 80 of the 1953 Compiled Ordinances of the City of Grand Junction, Colorado, being Ordinance No. 700, is hereby amended to read as follows:

Land Required for Other Public Purposes. The owners of the land in each subdivision shall allocate and convey 5% of the area of the land in such subdivision, exclusive of streets and alleys, for park, playgrounds, school, recreational, fire protection or similar public purposes, at such location as shall be designated by the City or at the option of the City said owners shall, in lieu of such conveyance of land in kind, pay to the City in cash an amount equal to 5% of the value of the land. If the City and the owners fail to agree on the value of said land, such value shall be fixed and established by the Real Estate Appraisal Committee of the Grand Junction Board of Realtors. The proceeds of said payments shall be deposited in a separate City account and shall be used only for the acquisition of land for parks, playgrounds, recreational, fire protection or similar public purposes.
