ORDINANCE NO. 907

 

AN ORDINANCE PROVIDING FOR THE CREATION OF A CITY PLANNING COMMISSION

 

 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:

 

 WHEREAS, Article 59 of Chapter 139 of Colorado Revised Statutes 1953, provides that a City may create a Planning Commission with powers and duties therein set forth; and

 

 WHEREAS, the City Council of the City of Grand Junction desires to create a Planning Commission in accordance with the provisions of such article with powers and duties as set forth in such article, except as otherwise herein provided.

 

 THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION:

 

 Section 1. There is hereby created a Planning Commission for the City of Grand Junction, to be known as the "Grand Junction Planning Commission," and hereinafter referred to in this ordinance as the "Commission." The Commission shall consist of five members, and the members of such Commission shall be appointed by the President of the Council. The fact that a person is a Council member, a municipal officer or municipal employee shall not prevent such person from being a member of the Commission. All members of such Commission shall be bona fide residents of the City and if a member ceases to reside in the City his membership on the Commission shall immediately terminate. All members of the Commission shall serve as such without compensation. The term of each appointed member shall be six years or until his successor takes office, except that the respective terms of one of the members first appointed shall be two years, two members shall be four years and two members shall be six years. Members may be removed after public hearing, by the President of the Council for inefficiency, neglect of duty or malfeasance in office. The President of the Council shall file a written statement of reasons for such removal. Vacancies shall be filled by the President of the Council.

 

 Section 2. The President of the City Council shall appoint an advisory board composed of five members whose qualifications and terms of office shall be the same as provided in Section 1. Such Board shall act as an advisor to the Commission and shall be permitted to participate in all meetings of the Commission, except that the members of the advisory board shall have no right to vote upon questions decided by the Commission.

 

 Section 3. Except as otherwise provided in this ordinance, the Commission shall be governed by the provisions of Article 59, Chapter 139, Colorado Revised Statutes 1953 and the Commission and other City officials mentioned in said Article 59 shall have all of the powers provided for in said Article 59 and shall exercise all of the functions and be governed by the procedures therein set forth.

 

 Section 4. Sections 1, 2, and 3 of this ordinance shall be known respectively as Sections 1, 2, and 3 of Chapter 88, 1953, Compiled Ordinances of the City of Grand Junction, Colorado.
