ORDINANCE NO. 916

AN ORDINANCE AMENDING SECTION 12, CHAPTER 83 OF THE 1953 COMPILED ORDINANCES OF THE CITY OF GRAND JUNCTION, COLORADO AND TRANSFERRING CERTAIN FUNCTIONS OF THE BOARD OF ADJUSTMENT TO THE GRAND JUNCTION PLANNING COMMISSION.

 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION:

 Section 1. Section 12, Chapter 83 of the 1953 Compiled Ordinances of the City of Grand Junction, Colorado, being Section 12 of Ordinance No. 755, is hereby amended to read as follows:

 Section 12. CHANGES AND AMENDMENTS. The City Council may from time to time, on its own motion or on petition, after public notice and hearing as provided by law, and after report by the Grand Junction Planning Commission, amend, supplement or change the boundaries or regulations herein subsequently established. Whenever the owners of 50 per cent or more of the frontage in any district or part thereof present a petition duly signed and acknowledged to the Council requesting an amendment, supplement or change in the regulations prescribed for such district or part thereof, it shall be the duty of the Council to vote upon such petition within ninety days after the filing by the petitioners with the Clerk of the City Council. In case the proposed amendment, supplement or change be disapproved by the Grand Junction Planning Commission, or a protest be presented duly signed and acknowledged by the owners of 20 per cent or more, either of the area of the lots included in such proposed change, or those immediately adjacent in the rear thereof extending one hundred feet therefrom, or of those directly opposite thereto extending one hundred feet from the street frontage of such opposite lots, such amendment, supplement or change, shall not be passed except by an affirmative vote of at least three-fourths of the members of the City Council.

 Section 2. The City Council hereby finds that a special emergency exists and that the passage of this ordinance is necessary for the preservation of the public peace, health and safety, and this ordinance is hereby passed as an emergency ordinance.
