ORDINANCE NO. 949

 

AN ORDINANCE SUBMITTING TO A VOTE OF THE QUALIFIED TAXPAYING ELECTORS OF THE CITY OF GRAND JUNCTION, COLORADO, AT A SPECIAL MUNICIPAL ELECTION TO BE HELD APRIL 17, 1956, THE QUESTION OF ISSUING NEGOTIABLE COUPON BONDS OF THE CITY FOR THE PURPOSE OF ERECTING AND EQUIPPING A PUBLIC BUILDING TO BE USED AS A JAIL AND POLICE ADMINISTRATION BUILDING, AND BONDS OF THE CITY FOR THE PURPOSE OF EXTENDING AND IMPROVING THE SEWER SYSTEM OF THE CITY AND DECLARING AN EMERGENCY.

 

 WHEREAS, the City Council of the City of Grand Junction, Colorado, deems it necessary and desirable to issue bonds of the City in the sum of $240,000, for the purpose of erecting and equipping a public building to be used as a jail and police administration building, and bonds of the City in the sum of $460,000, to be issued from time to time, within the lawful debt limit of the City, for the purpose of extending and improving the sewer system of the City, subject to the approving vote of the qualified taxpaying electors of said City;

 

 THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:

 

 Section 1. That at a special municipal election to be held in the City of Grand Junction, Colorado, on the 17th day of April, 1956, there shall be submitted to a vote of the qualified taxpaying electors of the City, the questions stated in the form of ballot and notice hereinafter set forth.

 

 Section 2. The questions to be submitted shall be voted on at said election by such qualified taxpaying electors at the polling places stated in said notice, and the election on said question shall be conducted by the judges and clerks hereinafter appointed.

 

 Section 3. The ballots to be used in voting upon the questions hereinafter set forth shall be prepared and furnished by the City Clerk to the judges of election, to be by them furnished to the voters, and they shall be in substantially the following form:

SECOND QUESTION SUBMITTED:

 

"Shall the City Council of the City of Grand Junction, Colorado, contract an indebtedness on behalf of the City and upon the credit thereof, by issuing the negotiable coupon bonds of the City in the aggregate amount of $460,000, for the purpose of extending and improving the sewer system of the City, such bonds to be issued from time to time within the lawful debt limit of the City?"

INSTRUCTIONS TO VOTERS:

 

 The voter shall prepare his ballot, indicating his approval or disapproval of the foregoing propositions by placing a cross (x) Opposite the group of words above which expresses his choice and shall then deposit his ballot in the ballot box provided for such purpose.

 

 Section 4. The vote cast at said election on the question aforesaid shall be returned and canvassed and the result declared in the same manner as nearly as may be as provided by law for the return, canvass and the declaration of the result of votes cast at the election of municipal officers.

 

 Section 5. A notice of the time and place of said election shall be published on three successive days before said election, in The Daily Sentinel, a newspaper of general circulation published in the City of Grand Junction, Mesa County, Colorado, the first of which publications shall be at least fifteen (15) days before such election, and also a copy of such notice shall be posted at each polling place at least fifteen (15) days before such election, and the City Clerk is hereby charged with the duty of effectuating this provision.

 

 Said notice to be published and posted as aforesaid shall be in substantially the following form:

NOTICE OF BOND ELECTION OF TAXPAYING ELECTORS TO BE HELD ON TUESDAY, THE 17TH DAY OF APRIL, 1956.

 

 Pursuant to Ordinance No. 949 of the City of Grand Junction, Colorado, adopted and approved the 7th day of March, A. D. 1956, PUBLIC NOTICE IS HEREBY GIVEN that at a special municipal election to be held on Tuesday, the 17th day of April, 1956, at the polling places hereinafter designated, there will be submitted to the vote of the qualified taxpaying electors of the City of Grand Junction, Colorado, the following questions:

 

"Shall the City Council of the City of Grand Junction, Colorado, contract an indebtedness on behalf of the City and upon the credit thereof, by issuing the negotiable coupon bonds of the City in the aggregate amount of $240,000, for the purpose of erecting and equipping a public building to be used as a jail and police administration building?"

 

"Shall the City Council of the City of Grand Junction, Colorado, contract an indebtedness on behalf of the City and upon the credit thereof, by issuing the negotiable coupon bonds of the City in the aggregate amount of $460,000, for the purpose of extending and improving the sewer system of the City, such bonds to be issued from time to time within the lawful debt limit of the City?"

 

 The polling places for said election shall be:

 

City Hall, 5th and Rood Ave.

 

Hawthorne School, 4th and Hill Ave.

 

Orchard Ave. School, 16th and Orchard Ave.

 

Lowell School, N. 7th St.

 

Washington School, 904 Hill Ave.

 

 The polls will be open continuously from the hour of 7:00 o'clock A. M. to and until the hour of 7:00 o'clock P. M.

 

 The ballots to be used in voting upon the question submitted will be prepared and furnished by the City Clerk to the judges of election, to be by them furnished to the voters.

 

 The election will be held and conducted, as nearly as may be, in the manner prescribed by law for elections of municipal officers.

 

 Registration for said election will take place in the manner now provided by Law. Any person possessing qualifications to vote at said election but whose name does not appear on the official registration list, may register with the City Clerk of Grand Junction, Colorado, at any time during business hours up to and including Monday, the 2nd day of April, 1956, one week before said election.

 Section 7. By reason of the fact that said improvements should be made at the earliest possible time, a special emergency is declared to exist, this ordinance is declared to be necessary for the immediate preservation of the public peace, health and safety, and shall become effective upon its passage.

 I HEREBY CERTIFY that the foregoing emergency ordinance, entitled, "AN ORDINANCE SUBMITTING TO A VOTE OF THE QUALIFIED TAXPAYING ELECTORS OF THE CITY OF GRAND JUNCTION, COLORADO, AT A SPECIAL MUNICIPAL ELECTION TO BE HELD APRIL 17th, 1956, THE QUESTION OF ISSUING NEGOTIABLE COUPON BONDS OF THE CITY FOR THE PURPOSE OF ERECTING AND EQUIPPING A PUBLIC BUILDING TO BE USED AS A JAIL AND POLICE ADMINISTRATION BUILDING, AND BONDS OF THE CITY FOR THE PURPOSE OF EXTENDING AND IMPROVING THE SEWER SYSTEM OF THE CITY AND DECLARING AN EMERGENCY," was introduced, read, passed and adopted as an emergency ordinance, numbered 949 and ordered published by the unanimous vote of the members of the City Council of the City of Grand Junction, at a regular meeting of said Council, held on the 7th day of March, 1956.
