ORDINANCE NO. 970

 

AN ORDINANCE RELATING TO MOYER POOL AND LINCOLN PARK POOL

 

 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:

 

 Section 1. NAMES OF POOLS. The swimming pool constructed by the City of Grand Junction in Lincoln Park during the year 1956 shall be known as "Lincoln Park Pool." "Moyer Pool" shall continue to have that designation.

 

 Section 2. CHILDREN'S USE. The use of Moyer Pool on Wednesday and Saturday, between the hours of 9:30 o'clock a.m. and 12:00 o'clock noon, and between 2:00 o'clock p.m. and 5:00 o'clock p.m., of each week during the bathing season shall be free to children under 16 years of age. The wading pools at Lincoln Park shall be available without charge to younger children under such rules and regulations as the City Manager may prescribe.

 

 Section 3. SCHEDULE OF CHARGES. The following charges shall be made for the use of pools, "adult" meaning a person 16 years of age or older, "child" meaning a person under 16 years of age, and "season" meaning the bathing season:

Towel rental at each pool shall be an amount not exceeding 15ยข per towel as shall be fixed from time to time by the City Manager.

 

Persons having a season ticket for Lincoln Park Pool shall be permitted to use Moyer Pool without further admission charge.

 

 Section 4. HOURS. The swimming pools shall be open during such hours as shall be specified from time to time by the City Manager.

 

 Section 5. SWIMMING INSTRUCTIONS. All swimming instructions shall be given in Moyer Pool. Classes for swimming instructions shall be conducted during such days and hours as shall be specified from time to time by the City Manager.

 

 Section 6. DEFACING AND USE OF POOLS WHILE INTOXICATED FORBIDDEN. It shall be unlawful for any person to write upon or disfigure, damage, mar or injure said pools or the buildings used in connection therewith, or use said pools while drunk or intoxicated, or conduct himself or herself improperly, and upon conviction thereof shall be fined in a sum of not less than five dollars nor more than one hundred fifty dollars.

 

 Section 7. INFECTIONS. No person shall be permitted to use said pools during such times as it shall appear that he or she has an infectious or contagious disease, including without limitation an infectious or contagious skin disease.

 

 Section 8. SWIMMING POOL FUNDS. All accounts, income, receipts and disbursements of such pools and the buildings and business in connection therewith shall be kept separate and distinct from the accounts of any other department and, subject to the provisions of other ordinances, shall be used for and on account of said pools, buildings and business and the grounds connected with said pools.

 

 Section 9. REPEAL. Sections 3 to 7, inclusive, Chapter 15, 1953 Compiled Ordinances of the City of Grand Junction are hereby repealed.

 

 Section 10. Sections 1 through 8 of this ordinance shall be known respectively as Sections 3 to and including 10 of said Chapter 15.

 

 Section 11. It is hereby declared that a special emergency exists, that this ordinance is necessary for the preservation of the public peace, health and safety, and that this ordinance shall take effect upon its passage and be published within three days.
