ORDINANCE NO. 1013

 

AN ORDINANCE ADOPTING BY REFERENCE THE MODEL TRAFFIC ORDINANCE PROMULGATED BY THE COLORADO HIGHWAY SAFETY COUNCIL, A DIVISION OF THE EXECUTIVE DEPARTMENT OF THE STATE GOVERNMENT, AND ADOPTED BY SUCH COUNCIL ON JANUARY 15, 1952; AND SETTING FORTH THE PENALTIES FOR VIOLATIONS THEREOF AS THEREIN SET OUT.

 

 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION:

 

 1. That the Model Traffic Ordinance, promulgated and adopted on January 15, 1952, by the Colorado Highway Safety Council, a division of the Executive Department of the State government, is hereby adopted as the Traffic Ordinance of the City of Grand Junction.

 

 2. That such Model Traffic Ordinance shall upon final passage repeal Chapter 47 of the 1953 Compiled Ordinances of the City of Grand Junction, and shall be and become Chapter 47 of such compiled ordinances.

 

 3. That, as to the various officials and departments concerned with and mentioned in said Model Traffic Ordinance, said Ordinance is adopted in conformity with the existing departments and official positions in the governmental operation of the City of Grand Junction or as the City Council may hereafter direct.

 

 4. The penalties provided in said Model Traffic Ordinance are as follows:

 

 a.  Penalties for violations of Regulations for Bicycles.

 

   Section 105 - Penalties -- Every person not a juvenile, as such is defined by the laws of the State of Colorado, found guilty of a violation of any provisions of this article shall be punished by a fine of not more than $25.00 (twenty-five dollars), or by removal and detention of the license plate from such person's bicycle for a period not to exceed ninety (90) days or by impounding of such person's bicycle for a period not to exceed ninety (90) days. Upon the recommendation of a Judge of a Juvenile Court or a County Court having jurisdiction over the person of a minor, the Chief of Police may remove and detain the license from such minor's bicycle for such period as said court may determine.

 

 b.  Penalties for driving while under the influence of liquor or drugs.

 

   Section 116 (b) Every person who is found guilty of a violation of this section shall be punished by imprisonment for not more than ninety (90) days, or by fine of not more than $300.00 (three hundred dollars.)

 

 c.  Penalties for reckless driving.

 

   Section 117 (b) Every person found guilty of reckless driving shall be punished by imprisonment for a period of not more than ninety (90) days, or by fine of not more than $300.00 (three hundred dollars.)

 

 d.  Penalties for careless driving.

 

   Section 118 -- Every person found guilty of careless driving shall be punished by a fine of not more than $300.00 (three hundred dollars) or by imprisonment for a period of not more than ninety (90) days.

 

 e.  Penalties for failure to stop and remain at the scene of an accident resulting in injury or death to a person or damage to property.

 

   Section 119 (b) Any person failing to stop or comply with said requirements under such circumstances shall be guilty of violations of this ordinance, and shall upon being found guilty be punished by imprisonment for not more than ninety (90) days or a fine of not more than $300.00 (three hundred dollars.)

 

 f.  Penalties for all other violations of the Model Traffic Ordinance.

 

   Section 135 -- Penalties. -- Unless another penalty is expressly provided herein, every person found guilty of a violation of any provision of this ordinance, may be punished by a fine of not more than $300.00 (three hundred dollars) or by imprisonment for not more than ninety (90) days.
