ORDINANCE NO. 1035

 

AN ORDINANCE AMENDING SECTION 183 OF CHAPTER 47 OF THE 1953 COMPILED ORDINANCES OF THE CITY OF GRAND JUNCTION IMPOSING RESTRICTIONS UPON USE OF STREETS AND DECLARING AN EMERGENCY.

 

 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:

 

 Section 1. That Section 183 of Chapter 47 of the 1953 Compiled Ordinances of the City of Grand Junction be amended to read as follows:

 

 Section 183. -- Traffic engineer to impose restrictions upon use of streets. The traffic engineer when so directed by the City Council is hereby authorized to prohibit the use of the roadway by farm tractors, trailers, semi-trailers, and by trucks or other commercial vehicles, and to impose limitations as to the weight thereof on designated streets where in his opinion the public safety is concerned, but said prohibitions and limitations shall not become effective until notice thereof is given by means of appropriate signs placed on such streets.

 

 To prevent undue hardship, where the necessity therefor is shown and where public health, safety and welfare is not endangered thereby, permits may be issued by the traffic engineer permitting the deviation from the routes established by Article 21, Schedule 8 hereof. Such permits shall be issued by the traffic engineer upon payment of a fee to cover the costs of such issuance and administration as determined by the traffic engineer. Each permit issued shall expire on December 31 of the year in which it is issued and shall state that the vehicle for which it was issued shall be permitted to deviate from the established routes only at such times as the vehicle is actually engaged in picking up or delivering cargo. Any vehicle for which such a permit shall have been issued shall take the most direct route from the regularly designated routes to destination and return. Abuse of the rights granted under the permit may result in its being canceled.

 

 Section 2. It is hereby declared that a special emergency exists; that this ordinance is necessary for the preservation of the public peace, health and safety; and that this ordinance shall take effect upon its passage.
