ORDINANCE NO. 1088

AN ORDINANCE ANNEXING TERRITORY TO THE CITY OF GRAND JUNCTION

WHEREAS, a Petition to annex the property hereinafter described to the City of Grand Junction, Colorado, was filed with the City Clerk and considered by the City Council on September 2, 1959; and

WHEREAS the said City Council at that time found the said territory to be eligible for annexation, the Petition to be signed by the required number of landowners, and all other requirements of Section 2 of Chapter 314, Session Laws of Colorado, 1947, to be satisfactorily complied with; and

WHEREAS, the City Council did accept and approve the said Petition for annexation by its Resolution dated September 2, 1959; and,

WHEREAS, Notice of the filing of said Petition has been published once each week for four publications in The Daily Sentinel, the first publication being on September 5, 1959, and the last publication being on September 26, 1959; and,

WHEREAS, 30 days have elapsed after the first publication of said Notice and no counter-petition or written objection to the said annexation has been filed with the City Clerk of the City of Grand Junction;

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:

That the said annexation is approved and that the following described property shall be, and it is hereby declared to be, annexed to the City of Grand Junction, Colorado:

Beginning at a point which is 239.0 feet South of the Northeast corner of the Southeast quarter of the Southwest Quarter of Section 13, Township 1 South, Range 1 West, Ute Meridian, Mesa County, Colorado, thence South 72o52' West 673.7 feet along the Denver and Rio Grande Western Railroad right-of-way, thence North 30o04' West 69.1 feet, thence North 59o56' East 494.7 feet, thence North 73o52' East 464.3 feet, thence North 62o55' East 463.6 feet, thence North 72o52' East 1100 feet, thence South 17o08' East to the railroad right-of-way, thence South 72o52' West to the point of beginning.

Also highway right-of-way described as follows:From the Northeast corner of the Southeast Quarter of Section 13, Township 1 South, Range 1 West, Ute Meridian, Mesa County, Colorado, thence South 00o05' West 290.5 feet, thence South 72o52' West 1077.7 feet for the point of beginning, thence South 17o08' East 200 feet, thence westerly along the South right-of-way line of U.S. Highway 6 & 24 to the present East City limits line, thence North along the City limits line to the North right-of-way line of Main Street in the said City, thence easterly along the present City limits line and along the North right-of-way line of U.S. Highway 6 & 24 to the point of beginning.

I HEREBY CERTIFY that the foregoing ordinance, being Ordinance No. 1088 was introduced, read and ordered published by the City Council of the City of Grand Junction, Colorado, at a regular meeting of said body held on the 7th day of October, and that the same was published in The Daily Sentinel, a newspaper published and in general circulation in said City at least ten days before its final passage.
