ORDINANCE NO. 1096

AN ORDINANCE ANNEXING TERRITORY TO THE CITY OF GRAND JUNCTION

AND DECLARING AN EMERGENCY.

WHEREAS, a Petition to annex the property hereinafter described to the City of Grand Junction, Colorado, was filed with the City Clerk and considered by the City Council on October 7, 1959; and

WHEREAS, the said City Council at that time found the said territory to be eligible for annexation, the Petition to be signed by the required number of landowners, and all other requirements of Section 2 of Chapter 314, Session Laws of Colorado, 1947, to be satisfactorily complied with; and,

WHEREAS, the City Council did accept and approve the said Petition for annexation by its Resolution dated October 7, 1959; and,

WHEREAS, Notice of the filing of said Petition has been published once each week for four publications in The Daily Sentinel, the first publication being on October 9, 1959, and the last publication being on October 30, 1959; and,

WHEREAS, 30 days have elapsed after the first publication of said Notice and no counter-petition or written objection to the said annexation has been filed with the City Clerk of the City of Grand Junction;

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:

Section 1. That the said annexation is approved and that the following-described property shall be, and it is hereby declared to be, annexed to the City of Grand Junction, Colorado:

The Southeast quarter of Section 10, Township 1 South, Range 1 West, Ute Principal Meridian, Mesa County, except a tract of land described as follows:

Beginning at the Northwest corner of the South half of the Southeast quarter of Section 10, Township 1 South, Range 1 West, Ute Principal Meridian, thence South 1303.70 feet to the South quarter corner of said Section 10, thence East along the South line of Section 10 to the Southeast corner of said Section 10, thence North 100 feet, thence Northwesterly along North highway right of way to a point on the East line of the West half of the Southwest quarter of the Southeast quarter of Section 10, Township 1 South, Range 1 West, Ute Principal Meridian which is 894.5 feet South of the Northeast corner of said West half of the Southwest quarter of the Southeast quarter of Section 10, thence North 894.5 feet to the Northeast corner of said West half of the Southwest quarter of the Southeast quarter of said Section 10, thence West 670.7 feet to the point of beginning.

Section 2. It is hereby declared that a special emergency exists; that this ordinance is necessary for the preservation of the public peace, health and safety; that this ordinance shall take effect upon its passage.

I HEREBY CERTIFY that the foregoing emergency ordinance entitled AN ORDINANCE ANNEXING TERRITORY TO THE CITY OF GRAND JUNCTION AND DECLARING AN EMERGENCY was introduced, read, passed and adopted as an emergency ordinance, numbered 1096 and ordered published by the unanimous vote of the members of the City Council of the City of Grand Junction, at a regular meeting of said Council held on the 2nd day of December, 1959.
