ORDINANCE NO. 1108
AN ORDINANCE AMENDING CHAPTER 72 OF THE 1953 COMPILED ORDINANCES OF THE CITY OF GRAND JUNCTION, COLORADO, ENTITLED “SECOND HAND BUSINESS”, DEFINING SAID BUSINESS, PROVIDING FOR THE LICENSING THEREOF, PROVIDING FOR THE KEEPING OF BOOKS AND RECORDS, AND PROVIDING FOR LIMITATIONS UPON SALE OF SECOND HAND MERCHANDISE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:
That Chapter 72 of the 1953 Compiled Ordinances of the City of Grand Junction, Colorado, be amended to read as follows:
Section 1 SECOND HAND BUSINESS - FEE FOR LICENSE. No person, firm or corporation, either as principal, agent or employee, shall establish, engage in, or carry on the business of dealing in second hand articles, either separately or in connection with some other business, without first having obtained a license therefor from the City Clerk of said City, for which the license fee shall be the sum of Twenty Five ($25.00) Dollars per year, or fraction thereof. The term “business of dealing in second hand articles”, as used in this ordinance, shall mean and include the purchase or sale of any second hand articles of whatsoever nature; provided that nothing contained herein shall be construed to apply to pianos, books, magazines tapestries, paintings, drawings, etchings, engravings, or to exchanges, returns or credits of merchandise when the article or articles exchanged, returned or credited are accepted in full or part payment for like merchandise; provided, however, that any person, firm or corporation holding a valid junk dealers license may also engage in the business of dealing in second hand merchandise conducting such business in accordance with the provisions of this ordinance under said license.
Section 2. BOOKS AND RECORDS - WEEKLY REPORTS. Every person, firm or corporation licensed under this ordinance shall keep a book in the form prescribed by the Chief of Police of the City of Grand Junction, in which shall be plainly written in ink, at the time of each purchase, an accurate description in the English language, of the goods, article or thing purchased, the date of the receipt of the same and the name, residence and description of the person selling the same, which book, as well as the article purchased, shall at all times be open to the inspection of any member of the Police Department. Every person, firm or corporation licensed under this ordinance shall make a weekly report in writing in the form prescribed by the Chief of Police of the City of Grand Junction, to the Chief of Police of said city, giving an accurate description of the goods, article or thing purchased or received, the date of the receipt of the same and the name, residence and description of the person selling the same.
Section 3. SECOND HAND DEALER SHALL GIVE A BOND. A license shall not be issued to a second hand dealer until he shall have given a good and sufficient bond to the City of Grand Junction in the sun of One Thousand ($1,000.00) Dollars, conditioned upon such dealer’s observing the laws of the State of Colorado and the ordinances and Charter of the City of Grand Junction.
Section 4. SALES WITHIN FIVE DAYS OF PURCHASE. No person, firm or corporation licensed under this ordinance shall sell or remove from his place of business any such second hand goods, article or thing, purchased by him as aforesaid, until the same shall have been in his possession at least five (5) days.
Section 5. PURCHASES FROM MINORS, ETC. No person, firm or corporation licensed under this ordinance shall purchase any second hand goods, article or thing from any person under 18 years of age, or from any person who at the time of the purchase is intoxicated, or from any person known by the purchaser to be a thief or an associate of thieves, or receiver of stolen property, or from any person he has reason to suspect of being such.
