ORDINANCE NO. 1117

AN ORDINANCE AMENDING SECTION 3 OF CHAPTER 14 OF THE 1953 COMPILED OF THE CITY OF GRAND JUNCTION, COLORADO, CONCERNING LICENSE FEES AND CHARGES FOR THE USE OF LINCOLN PARK FACILITIES.

 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:

 That Section 3 of Chapter 14 of the 1953 Compiled Ordinances of the City of Grand Junction, Colorado, be amended to read as follows:

 Section 3.  CHARGES TO LICENSEE FOR USE. Except as the City Council may by written agreement otherwise provide the person, association, firm or corporation using said Lincoln Park for purposes where an admission charge is made shall pay to the City of Grand Junction the sum of ten (10) cents for each ticket sold when the price of said ticket, exclusive of the amount to be paid to the City, is ten (10) cents or greater. For the purposes of this Section, school and college Activity Tickets shall be considered to be sold for in excess of ten (10) cents per admission. Where charges are made by licensees other than admission charges, there shall be paid by the licensee to the City ten (10%) per cent of the gross receipts derived from said charges which monies shall be in addition to those required to be paid on admissions, if any.

 A minimum charge of Ten ($10) Dollars for each use of the baseball field and of Fifteen ($15) Dollars for each use of the football field shall be paid by all licensees using such facilities except when such facilities are used for practice or non-spectator activities; and, when used for such purposes, charges shall be as agreed upon between the City Manager and the licensee for such use.

 When the football or baseball facilities are used for nighttime activities, the licensee shall pay, in addition to all other charges hereinbefore referred to, the cost of the operation of the field lights.

 All charges made hereunder shall be paid to the City Treasurer on the first business day following the day of the closing of the activity out of which the charges arose.
