ORDINANCE NO. 1119

AN ORDINANCE AMENDING SECTION 1 OF CHAPTER 72 OF THE 1953 COMPILED ORDINANCES OF THE CITY OF GRAND JUNCTION, COLORADO, CONCERNING SECOND HAND BUSINESS AND THE FEES FOR LICENSING THEREOF

 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:

 That Section 1 of Chapter 72 of the 1953 Compiled Ordinances of the City of Grand Junction, Colorado, be amended to read as follows:

 Section 1. SECOND HAND BUSINESS - FEE FOR LICENSE. No person, firm or corporation, either as principal, agent or employee, shall establish, engage in, or carry on the business of dealing in second hand articles, either separately or in connection with some other business, without first having obtained a license therefor from the City Clerk of said City, for which the license fee shall be the sum, of Twenty-Five ($25.00) Dollars per year, or fraction thereof. The term “business of dealing in second hand articles,” as used in this ordinance, shall mean and include the purchase or sale of any second hand articles of whatsoever nature, which shall include second hand automobile parts and accessories, except when the same are acquired by the purchase of the entire vehicle on which they are attached; provided that nothing contained herein shall be construed to apply to pianos, books, magazines tapestries, paintings, drawings, etchings, engravings, automobiles, or to exchanges, returns or credits of merchandise when the article or articles exchanged, returned or credited are accepted in full or part payment for like merchandise; provided, however, that any person, firm or corporation holding a valid junk dealers license may also engage in the business of dealing in second hand merchandise conducting such business in accordance with the provisions of this ordinance under said license.
