ORDINANCE NO. 1132

AN ORDINANCE ANNEXING TERRITORY TO THE CITY OF GRAND JUNCTION

WHEREAS, a Petition to annex the property hereinafter described to the City of Grand Junction, Colorado was filed with the City Clerk and considered by the City Council on April 5, 1961; and

WHEREAS, the said City Council at that time found the said territory to be eligible for annexation, the Petition to be signed by the required number of landowner, and all other requirements of Section 2 of Chapter 314, Session Laws of Colorado, 1947, to be satisfactorily complied with; and,

WHEREAS, the City Council did accept and approve the said Petition for annexation by its Resolution dated April 5, 1961; and,

WHEREAS, Notice of the filing of said Petition has been published once each week for four publications in The Daily Sentinel, the first publication being on April 8, 1961, and the last publication being on April 29, 1961; and

WHEREAS, a Counter-petition against the said annexation has been filed with the City Clerk of the City of Grand Junction, which counter-petition substantially meets the requirements of Chapter 139-11-4 of the 1953 Colorado Revised Statutes;

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:

1. That the said annexation is approved and that the following described property shall be, and it is hereby declared to be, annexed to the City of Grand Junction, Colorado:

Beginning at the intersection of the Westerly line of the Grand Valley Canal with the South line of the Southwest quarter Northeast quarter (SW1/4NE1/4) of Section 10, Township 1 South, Range 1 West, U. M. thence West along the said South line 333' to the east line drain ditch, thence North along the drain ditch 300 feet, thence East 75 feet more of less to the West line of the Pomona View Subdivision, thence Northeasterly along the said West line to the Northeast corner of Lot 14 of the said Subdivision, thence South 57.76 feet, thence East to the Northwest corner of Lot 12 in the said Subdivision, thence North 50 feet, thence East 100 feet to the East line of the Southwest quarter Northeast quarter (SW1/4NE1/4) of Section 10, Township 1 South, Range 1 West, U. M., thence South along the said East line to the Southeast corner of the said Southwest quarter Northeast quarter (SW1/4NE1/4), thence West along the South line of the said Southwest quarter Northeast quarter (SW1/4NE1/4) to the Point of Beginning.

2. That the proper procedure should immediately, upon the final passage of this ordinance, be undertaken to secure an election in the annexed territory in accordance with Chapter 139-11-4 of the 1953 Colorado Revised Statutes.

I HEREBY CERTIFY that the foregoing ordinance, being Ordinance No. 1132, was introduced, read and ordered published by the City Council of the City of Grand Junction, Colorado, at a regular meeting of said body held on the 17th day of May, 1961, and that the same was published in The Daily Sentinel, a newspaper published and in general circulation in said City at least ten days before its final passage.
