ORDINANCE NO. 1133

 

AN ORDINANCE ANNEXING TERRITORY TO THE CITY OF GRAND JUNCTION

 

WHEREAS, a Petition to annex the property hereinafter described to the City of Grand Junction, Colorado was filed with the City Clerk and considered by the City Council on May 17, 1961; and

 

WHEREAS, the said City Council at that time found the said territory to be eligible for annexation, the Petition to be signed by the required number of landowners, and all other requirements of Section 2 of Chapter 314, Session Laws of Colorado, 1947, to be satisfactorily complied with; and,

 

WHEREAS, the City Council did accept and approve the said Petition for annexation by its Resolution dated May 17, 1961; and,

 

WHEREAS, Notice of the filing of said Petition has been published once each week for four publications in The Daily Sentinel, the first publication being on May 22, 1961, and the last publication being on June 12, 1961; and,

 

WHEREAS, a Counter-petition against the said annexation has been filed with the City Clerk of the City of Grand Junction, which counter-petition substantially meets the requirements of Chapter 139-11-4 of the 1953 Colorado Revised Statutes;

 

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:

 

1. That the said annexation is approved and that the following described property shall be, and it is hereby declared to be annexed to the City of Grand Junction, Colorado:

 

The Southeast Quarter of Section 7, Township 1 South, Range 1 East, Ute Meridian; that part of the Northeast Quarter of Section 18, Township 1 South, Range 1 East, Ute Meridian lying North of Highway 6 and 24; the Northeast Quarter of the Northwest Quarter of Section 18, Township 1 South, Range 1 East, Ute Meridian; the Southwest quarter of the Northeast Quarter of Section 7, Township 1 South, Range 1 East, Ute Meridian except that part which lies East of Indian Waste; that part of the North Half Southeast Quarter Northeast Quarter of Section 7, Township 1 South, Range 1 East, Ute Meridian, which lies North of the Grand Valley Canal and West of Indian Waste; all in Mesa County, Colorado, further described as follows:

 

Beginning at the Northwest Corner of the South Half of the Northeast Quarter of Section 7, Township 1 South, Range 1 East, Ute Meridian, Thence East along the North line of said South Half of the Northeast Quarter to intersection with Indian Waste; thence Southwesterly along said Indian Waste to intersection with the South line of said South Half of the Northeast Quarter, thence East along said South line to the East Quarter Corner of said Section 7, thence South along the East line of said Section 7 to the Southeast Corner of said Section 7, thence South along the East line of Section 18, Township 1 South, Range 1 East, Ute Meridian, to the intersection with the North line of Highway 6 and 24, thence Southwesterly along said North line of Highway 6 and 24 to the intersection with the East line of the West Half of said Section 18, thence North along the said East line to the Southeast Corner of the Northeast Quarter of the Northwest Quarter of said Section 18, thence West along the South line of the said Northeast Quarter of the Northwest Quarter of the Northwest Quarter, thence North along the West line of the said Northeast Quarter of the Northwest Quarter to the Northwest Corner of the said Northeast Quarter of the Northwest Quarter, thence East along the North line of Section 18, Township 1 South, Range 1 East, Ute Meridian, to the North Quarter Corner of said Section 18, thence North along the North-South center line of Section 7, Township 1 South, Range 1 East, Ute Meridian to the point of beginning, all in Mesa County, Colorado. (Central Fruitvale Annexation).

 

2. That the proper procedure should immediately, upon the final passage of this Ordinance, be undertaken to secure an election in the annexed territory in accordance with Chapter 139-11-4 of the 1953 Colorado Revised Statutes.

I HEREBY CERTIFY that the foregoing ordinance, being Ordinance No. 1133, was introduced, read and ordered published by the City Council of the City of Grand Junction, Colorado, at a regular meeting of said body held on the 5th day of July, 1961, and that the same was published in The Daily Sentinel, a newspaper published and in general circulation in said City at least ten days before its final passage.
