ORDINANCE NO. 1148
AN ORDINANCE ESTABLISHING "SPECIAL STORM SEWER DISTRICT NO. 1, GRAND JUNCTION, COLORADO, A GENERAL IMPROVEMENT DISTRICT" WITHIN A PART OF THE CITY OF GRAND JUNCTION, COLORADO, UNDER THE PROVISIONS OF ARTICLE IV, CHAPTER 89, COLORADO REVISED STATUTES, 1953, AS AMENDED, AND DECLARING AN EMERGENCY.
WHEREAS, petitions for the creation of "Special Storm Sewer District No. 1, Grand Junction, Colorado, a General Improvement District," under the provisions of Article IV, Chapter 89, Colorado Revised Statutes, 1953, as amended, and under which shall be constructed a Storm Sewer for the district of lands, to-wit:

All of said blocks being in the City of Grand Junction, Mesa County, Colorado, and
East 125 feet of Block 6

Said blocks being in Richard D. Mobley's First Subdivision, in the City of Grand Junction, Mesa County, Colorado
have been presented to the City Council of the City of Grand Junction, Colorado; and
WHEREAS, at the hearing on said petitions duly advertised for and held on the 17th day of January, 1962, the said City Council did find that such petitions were duly signed by a majority of the tax-paying electors of the proposed district who owned property in said district having an assessed value of more than one-half of the assessed value of all the real and personal property taxable in said district; and, further, did find the allegations of the petitions were true; and did find that such petitions were in conformity with the provisions of Article IV, Chapter 89, Colorado Revised Statutes, 1953, as amended;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:
1. That it is determined by said City Council that all provisions of Article IV, Chapter 89, Colorado Revised Statutes, 1953, as amended, for the formation of "Special Storm Sewer District No. 1, Grand Junction, Colorado, a General Improvement District" have been complied with and said City Council has the authority to create such district.
2. That there is hereby organized within the City of Grand Junction an Improvement District with the corporate name of "Special Storm Sewer District No. 1, Grand Junction, Colorado, a general Improvement District" under which shall be constructed a storm sewer under the provisions of and in accordance with Article IV, Chapter 89, Colorado Revised Statutes, as amended.
3. That the district of lands within such district is as follows:

4. As the improvements in said district are urgently needed and must be made as the first construction under the City's "Operation Foresight," it is hereby declared that an emergency exists, that this Ordinance is necessary for the immediate preservation of the public peace, health and safety.
PASSED AND ADOPTED this 7th day of February, 1962.

I HEREBY CERTIFY that the foregoing emergency ordinance, entitled AN ORDINANCE ESTABLISHING "SPECIAL STORM SEWER DISTRICT NO. 1, GRAND JUNCTION, COLORADO, A GENERAL IMPROVEMENT DISTRICT" WITHIN A PART OF THE CITY OF GRAND JUNCTION, COLORADO, UNDER THE PROVISIONS OF ARTICLE IV, CHAPTER 89, COLORADO REVISED STATUTES, 1953, AS AMENDED, AND DECLARING AN EMERGENCY, was introduced, read, passed and adopted as an emergency ordinance, numbered 1148 an ordered published by the unanimous vote of the members of the City Council of the City of Grand Junction, at a regular meeting of said Council held on the 7th day of February, 1962.
