ORDINANCE NO. 1151
AN ORDINANCE CREATING AND ORGANIZING "SPECIAL STORM SEWER DISTRICT NO. 1, GRAND JUNCTION, COLORADO, A GENERAL IMPROVEMENT DISTRICT" WITHIN A PART OF THE CITY OF GRAND JUNCTION, COLORADO, AND DECLARING AN EMERGENCY.
WHEREAS, petitions for the organization of "Special Storm Sewer District No. 1, Grand Junction, Colorado, a General Improvement District," have been heretofore presented to the City Council of the City of Grand Junction, Colorado; and,
WHEREAS, said petitions are signed by not less than a majority of the taxpaying electors who own real or personal property in the proposed District having an assessed value of not less than one-half of the assessed value of all the real and personal property in said District; and,
WHEREAS, said petitions comply fully with the requirements of Chapter 89, Article IV, Colorado Revised Statutes 1953, as amended; and,
WHEREAS, a bond has been filed to pay all expenses connected with the proceedings in case the organization of the District is not effected, which bond is hereby approved; and,
WHEREAS, on the 7th day of March, 1962, the City Council of said City adopted a Resolution authorizing notice of hearing on the petitions for the organization of said District, said date of hearing being the 4th day of April, 1962; and,
WHEREAS, the Clerk of said City has caused notice by publication to be made of the pendency of the petitions, of the purposes and boundaries of the proposed District, and of the time and place of hearing thereon, such notice having been published in the Daily Sentinel, a newspaper of general circulation in said District; and,
WHEREAS, the Clerk of said City also caused a copy of the notice of said hearing to be mailed to each taxpaying elector of the District at his or her last-known address, as disclosed by the tax records of Mesa County, Colorado; and
WHEREAS, on the 4th day of April, 1962, the City Council of said City, at its regular meeting, met for the purpose of holding a hearing on the petitions for the organization of said District; and,
WHEREAS, no one appeared to be heard against the creation of the said District; and,
WHEREAS, said City Council has ascertained that said petitions were signed by the required number of taxpaying electors of the District, owning the required amount of property therein; and
WHEREAS, said City Council has determined, and hereby determines, that the allegations of said petitions are true, and that it has jurisdiction in the premises; and,
WHEREAS, said City Council has determined that the proposed improvements in said District will confer a general benefit on the District, and that the cost of such improvements would not be excessive, as compared with the value of the property within the District;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:
1. That said District has been duly organized and created.
2. That the corporate name of said District shall be "Special Storm Sewer District No. 1, Grand Junction, Colorado, a General Improvement District," by which name in all proceedings it shall hereafter be known, and said District shall be a public or Quasi-municipal subdivision of the State of Colorado, and a body corporate with the limited proprietary powers set forth in said Chapter 89, Article IV, Colorado Revised Statutes, 1953, as amended.
3. The District of lands within such District shall be as follows:

Said blocks being in Richard D. Mobley's Subdivision, in the City of Grand Junction, Mesa County, Colorado.
4. Within thirty (30) days after the date of the adoption of this Ordinance, the City Clerk shall submit to the County Clerk and Recorder of Mesa County, Colorado, a copy of this Ordinance to be filed in said office.
5. As the improvements in said District are imperatively needed, it is hereby declared that an emergency exists, that this Ordinance is necessary for the immediate preservation of the public peace, health and safety, and shall be in full force and effect immediately upon its passage.

I HEREBY CERTIFY that the foregoing emergency ordinance, entitled "AN ORDINANCE CREATING AND ORGANIZING `SPECIAL STORM SEWER DISTRICT NO. 1, GRAND JUNCTION, COLORADO, A GENERAL IMPROVEMENT DISTRICT' WITHIN A PART OF THE CITY OF GRAND JUNCTION, COLORADO, AND DECLARING AN EMERGENCY," was introduced, read, passed and adopted as an emergency ordinance, numbered 1151 and ordered published by the unanimous vote of the members of the City Council of the City of Grand Junction, at a regular meeting of said Council held on the 4th day of April, 1962.
