ORDINANCE NO. 1172

AN ORDINANCE APPROPRIATING MONIES FROM VARIOUS FUNDS WITHIN THE BUDGET OF THE CITY or GRAND JUNCTION, COLORADO, TO THE UTILITIES DEPARTMENT SEWER PLANT CONTINGENCY FUND TO PROVIDE MONIES FOR THE PAYMENT OF THE COMPROMISE OF A SUIT AGAINST THE CITY; AUTHORIZING THE PAYMENT OF SUCH MONIES; AND DECLARING AN EMERGENCY.

WHEREAS, an unforeseen contingency has arisen necessitating the appropriation of monies to provide for the expenditure of funds for the compromise of an action by certain plaintiffs against the City of Grand Junction, Colorado, arising out of the operation of its West Side Sewerage Treatment Plant:

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO

1.  That the City Treasurer be, and he hereby is, directed to transfer from the accounts hereinafter set forth the monies as indicated to the Utilities Department Budget Account No. 85.19-2.

 General Government Account 142.30-A      $3,000.00

 General Government Account 141.19-11       3,000.00

 Utilities Department Account No. 85.31-A    15,000.00

 Utilities Department Account No. 85.19-11     4,000.00

2.  That the City Treasurer, upon the request of the City Manager, is hereby directed to pay to James J. Carter or to whom he may direct the sum of $25,000.00 from Utilities Department Account No. 85.19-2.

3. It is hereby declared that a special emergency exists; that this ordinance is necessary for the preservation of the public peace, health, and safety; and that this ordinance shall take effect upon its passage.

PASSED AND ADOPTED this 1st day of May, 1963.

I HEREBY CERTIFY that the foregoing emergency ordinance, entitled "AN ORDINANCE APPROPRIATING MONIES FROM VARIOUS FUNDS WITHIN THE BUDGET OF THE CITY OF GRAND JUNCTION, COLORADO, TO THE UTILITIES DEPARTMENT SEWER PLANT CONTINGENCY FUND TO PROVIDE MONIES FOR THE PAYMENT OF THE COMPROMISE OF A SUIT AGAINST THE CITY; AUTHORIZING THE PAYMENT OF SUCH MONIES AND DECLARING AN EMERGENCY," was introduced, read, passed and adopted as an emergency ordinance, numbered 1172 and ordered published by the unanimous vote of the members of the City Council of the City of Grand Junction, at a regular meeting of said Council held on the lst day of May, 1963.
