ORDINANCE N0. 1175
AN ORDINANCE ADOPTING BY REFERENCE THOSE PARTS OF THE MODEL TRAFFIC CODE FOR COLORADO MUNICIPALITIES 1962, PROMULGATED BY THE COLORADO HIGHWAY SAFETY COUNCIL, A DIVISION OF THE EXECUTIVE DEPARTMENT OF THE STATE GOVERNMENT, NOT SHOWN AS AMENDED, ALTERED OR ADDED TO; ADOPTING SUCH AMENDMENTS, ALTERATIONS OR ADDITIONS RELATING TO THE CONTROL OF TRAFFIC WITHIN THE CITY OF GRAND JUNCTION, COLORADO; AND PROVIDING FOR PENALTIES FOR VIOLATION OF SUCH CODE OR ORDINANCE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:
1. That the Model Traffic Code, together with the preliminary schedules therein referred to, for Colorado Municipalities 1962, promulgated by the Colorado Highway Safety Council, a division of the executive department of the State Government, is hereby adopted as the Traffic Ordinance for the City of Grand Junction, Colorado, except as the same is amended, altered or added to as set out in Section 2 hereof.
2. That the following amendments, alterations or additions are hereby adopted affecting the sections of said Model Traffic Code, as indicated, to-wit:
A. That Section 1 of said Model Traffic Code is amended to read as follows:
Section 1.--Vehicles Approaching or Entering Intersection Not Controlled by Stop Signs or Signals.--
(a) When two vehicles enter an intersection from different streets at approximately the same time, the driver of the vehicle on the left shall yield the right-of-way to the vehicle on the right.
(b) The foregoing rule is modified at through streets and as otherwise hereinafter stated in this article.
B. That Section 14 of said Model Traffic Code is amended to read as follows:
Section 14.--Careless Driving.--Every person operating a vehicle upon the streets within this municipality shall drive the same in a careful and prudent manner, having regard for the width, grade, curves, corners, traffic and all other attendant circumstances, so as not to endanger the life, limb, or property of any person. Failure to drive in such manner shall constitute careless driving and a violation of this ordinance.
C. That Section 38 Subsection (a) of said Model Traffic Code shall be amended by adding thereto a Section 18 to read as follows:
Section 38.--Stopping-, Standing, or Parking Prohibited in Specified PLACES ---(a) 18. on the space between the sidewalk and the curbing commonly known as the sidewalk parking except that the Traffic Engineer may grant permission for parking of vehicles bearing licenses for the current year after he has determined that such parking would not generate additional traffic hazards, and that such parking could be accomplished without driving over any curb or sidewalk.
D. That Section 41 of said Model Traffic Code shall be amended by adding thereto Subsections (c) and (d) which shall read as follows:
Section 41.--Stopping, Standing, or Parking in Alleys.--
(c) No person shall park a passenger vehicle in any alley listed under Schedule IV, subsection (b) except as provided in Section 144.
(d) No person shall park a vehicle in any alley within the City for longer than 30 minutes between the hours of 12:00 midnight and 5:00 A.M. of any day.
E. That Section 60 of said Model Traffic Code shall be amended by adding thereto a subsection (d) to read as follows:
Section 60.--Metered Parking Zones.--
(d) The regulations established by this Section shall also apply in metered off-street parking areas designated by the City Council.
F. That Section 143 of said Model Traffic Code shall be amended to read as follows:
Section 143.--The Traffic Engineer.--(a) The office of Traffic Engineer is hereby established. The Traffic Engineer shall be appointed by the CITY MANAGER of the municipality and shall exercise the powers and duties provided in this ordinance. In the absence of such appointment and at such other times as the Traffic Engineer may be absent from the municipality or incapable of performing his duties, the said duties, the said duties shall be vested in the Chief of Police, or other municipal official as determined and authorized by the CITY MANAGER.
(b) IT IS THE GENERAL DUTY OF THE TRAFFIC ENGINEER TO PLAN AND DETERMINE THE INSTALLATION AND PROPER TIMING AND MAINTENANCE OF TRAFFIC CONTROL DEVICES; TO PLAN AND DIRECT THE OPERATION OF TRAFFIC ON THE STREETS OF THIS MUNICIPALITY; INCLUDING PARKING AREAS; TO CONDUCT INVESTIGATIONS OF TRAFFIC CONDITIONS; TO COOPERATE WITH OTHER MUNICIPAL AND STATE OFFICIALS AND MAKE RECOMMENDATIONS FOR THE IMPROVEMENTS OF TRAFFIC MOVEMENT AND CONDITIONS, INCLUDING IMPROVEMENTS IN STREETS, AND TO CARRY OUT THE ADDITIONAL POWERS AND DUTIES WHICH MAY BE IMPOSED BY ORDINANCES OR THIS MUNICIPALITY OR AS DIRECTED BY THE PROPER AUTHORITY.
(c) The Traffic Engineer shall have the authority to modify the schedules shown as Sections 173 to 181 inclusive of this ordinance providing that an engineering study shows, in his opinion, such modification is necessary and in the public interest. Such modification shall be accomplished when the Traffic Engineer places whatever signs or meters may be required and files a copy of the modified schedule with the City Clerk.
G. That Section 144 of said Model Traffic Code is amended by the addition of a Subsection 24 to read as follows:
Section 144.--Other Powers of Traffic Engineer.--
24. Issue permits for loading in accordance with time limits and position provisions of Section 4l (a) of this Chapter. Said permit may be issued by the Traffic Engineer, or an appropriate City department designated in writing by the Traffic Engineer, upon application of the owner of a passenger vehicle used for business purposes and upon payment of a $5.00 annual fee; such permit must be affixed to the inside rear window of the vehicle for which issued. For purposes of this subsection, passenger vehicles shall be considered attended only when occupied by a licensed driver capable of operating the vehicle.
H. That Section 158 of said Model Traffic Code is amended to read as follows:
Section 158.--Holidays.--Where used in this ordinance or on official Signs erected by authorized official agencies shall in addition to Sundays mean those entire days herein declared to be holidays, to-wit;
New Year's Day Thanksgiving Day
Memorial Day Christmas Day
Independence Day Washington's Birthday
Labor Day Veterans Day
I. That Section 171 of said Model Traffic Code is amended to read as follows:
Section 171.--Short Title.-- This ordinance may be known and cited as the Traffic Ordinance and shall be Chapter 47 of the 1953 Compiled Ordinances of the City of Grand Junction.
3. That the following is adopted to provide penalties for the violation of the Traffic ordinance of the City of Grand Junction:
PENALTIES FOR VIOLATIONS OF THIS ORDINANCE
(1) It is unlawful for any person to violate any of the provisions of this Ordinance and such violations shall be punishable as is hereinafter provided.
(2) Every person convicted of a violation of any of the provisions of this Ordinance shall be subject to a fine not exceeding three hundred dollars, or by imprisonment not exceeding 90 days.
4. That the said Model Traffic Code, as amended, shall be designated as Chapter 47 of the 1953 Compiled Ordinances of the City of Grand Junction, Colorado, repealing the present Chapter 47 of the 1953 Compiled Ordinances of the City.
