ORDINANCE NO. 1189
AN ORDINANCE ESTABLISHING REGULATIONS FOR LICENSEES UNDER ARTICLES 1 AND 2 OF CHAPTER 75 OF THE 1953 COLORADO REVISED STATUTES, THE FERMENTED MALT BEVERAGE ACT AND THE LIQUOR CODE OF THE STATE OF COLORADO RESPECTIVELY AND PROVIDING FOR PENALTIES FOR THE VIOLATION OF SUCH REGULATIONS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:
Section 1. REGULATIONS.--Under the authority granted in Chapter 75, Articles 1 and 2, 1953 Colorado Revised Statutes to the local licensing authority, and under the general police power of the City, the following regulations are adopted by the City Council of the City of Grand Junction, Colorado, governing the conduct of operations by licensees under Article 1 of such Chapter, the Fermented Malt Beverage Act, as Amended, and Article 2 of such Chapter, the Liquor Code of 1935, as Amended:
a. A licensee under said Chapter shall be required to notify the Police Department of the City whenever any customer or customers within his establishment become disorderly in conduct by lewd or indecent display, rowdiness, fighting or challenging to fight, gambling, or any other conduct that would be offensive to the average citizen or to the residents of the neighborhood in which the establishment is located, and such requirement shall extend to such conduct in the area immediately adjacent to the premises as well as to the interior thereof.
b. A licensee whose principal operation permits the consumption of liquor or fermented malt beverage on the premises shall sell the same only to customers who are seated within the licensed premises or who are standing at a bar therein, and no person, except the licensee or his employees, shall carry such beverages from table to table or place to place; provided, however, that this regulation shall not apply in bowling alleys or pool halls, except that licensees shall provide drink racks for the use of its customers therein. Signs, to be provided by the City of Grand Junction, giving notice of this regulation shall be conspicuously posted within the establishment by all licensees to whom this regulation applies. Any person failing to observe the provisions of this section shall be deemed to be in violation of this ordinance.
c. Any licensee under the above Chapter shall be required to maintain a level of light within the licensed premises which will permit the checking of identification materials without resort to other lighting.
Section 2.--VIOLATION--PENALTY.--Any licensee, employee thereof, or other person violating any of the regulations above set forth shall be guilty of a misdemeanor and shall, upon conviction thereof, be fined not less than Ten Dollars ($10.00) nor more than Three Hundred Dollars ($300.00), and, in addition, such violation by a licensee or his employee, shall be ground for the suspension or revocation of the license held by the licensee after hearing by the City Council in accordance with the provisions of the stated Chapter.
Section 3.--ORDINANCE DESIGNATION.--This Ordinance shall be and become Chapter 34 of the 1953 Compiled Ordinances of the City of Grand Junction, Colorado.
