ORDINANCE NO. 1211

 

 AN ORDINANCE REGULATING PEDDLERS AND SOLICITORS, AND PROVIDING PENALTIES FOR VIOLATION THEREOF.

 

 

 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:

 

 Section 1. Definitions. When used in this ordinance, the following terms have the following meanings:

 

 a.  "Peddler" means any person, whether a resident of the City of Grand Junction or not, who goes from house to house, from place to place' or from street to street, con­veying or transporting goods, wares or merchandise or offering or exposing the same for sale, or making sales and delivering articles to purchasers.

 

 b.  "Solicitor" means any person, whether a resident of the City of Grand Junction or not, w ho goes from house to house, from place to place, or from street to street, soliciting sales or taking orders for sale of goods, wares or merchandise, including magazines, books, periodicals, real property or tangible or intangible personal property of any nature, including insurance in any form, for future delivery, or for service to be performed in the future, whether or not such individual has, carries or exposes for sale a sample of the subject of such order or whether or not he is collecting advance payments on such orders.

 

 Section 2. Regulation of Soliciting or Peddling. No Solicitor or Peddler shall go upon any premises within the City of Grand Junction unless invited to do so for the purpose of soliciting or peddling where the owner or occupant of such premises has indicated his desire not to be contacted for such purposes by the placing of a "No Solicitors" sign on the premises.

 

 Section 3. Penalty. Any person who violates this ordinance shall be guilty of a misdemeanor and upon convict on thereof shall be punished by a fine of not more than Three Hundred Dollars ($300.00).

 

 Section 4. Repeal of Conflicting Ordinances. This ordinance shall repeal any ordinances or parts of ordinances in conflict with it; and, in particular, shall repeal all of Chapter 69 of the 1953 Compiled Ordinances of the City of Grand Junction.
