ORDINANCE NO. 1244
AN ORDINANCE AMENDING SECTIONS 7 - 14, 7 - 47, 11 - 37 (a) (2), 15-27 (a), 17 - 20 AND 17 - 107 OF THE CODE OF ORDINANCES OF THE CITY OF GRAND JUNCTION TO REMOVE THE REQUIREMENTS FOR CITY COUNCIL APPROVAL OF CONTRACTOR'S AND CERTAIN OTHER BONDS
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION:
1. That Section 7-14 of the Code of Ordinances of the City of Grand Junction be amended to read as follows:
Section 7-14. License, bond required; license fee.
No person shall engage in the business of house moving, or move any building in, along, or across any public street, alley or public ground in the City, unless such person shall first have secured a license from the City to engage in such business; provided that before such license shall be granted, an annual fee of ten dollars shall be paid to the City Treasurer and a good and sufficient surety bond in the sum of one thousand dollars be approved by the building department, said bond to be conditioned upon the faithful performance of all things required under the provisions of this article and the payment of all damages caused in the moving of such building or part thereof.
2. That Section 7-47 of the Code of Ordinances of the City of Grand Junction be amended to read as follows:
Section 7-47. Bond required.
Before any license shall be issued for engaging in a business as a contractor, the applicant, in the event he is a special contractor as herein defined, shall file a good and sufficient surety bond in the sum of one thousand dollars, payable to the City, to be approved by the building department, conditioned that he will save and keep harmless the City and all persons therein of and from all damages on account of the failure of such contractor properly to build, construct, alter, repair, remodel or demolish any size or type of structure within the City in a manner provided by the uniform building code or any amendments thereto which have been, or may be, adopted by the City; all other contractors as defined herein shall file such a bond so conditioned in the amount of five thousand dollars. ($5,000)
3. That Section 11-37 (a) (2) of the Code of Ordinances of the City of Grand Junction be amended to read as follows:
Section 11-37. License, Bond required fees.
(a) (2) Such person shall also furnish a good and sufficient surety bond to be approved by the building department, in the sum of one thousand dollars, conditioned upon the faithful performance of all things required of them under the provisions of the ordinances of the City. Said bond shall be approved and filed with the City Clerk before issuance of such license.
4. That Section 15-27 (a) of the Code of Ordinances of the City of Grand Junction be amended to read as follows:
Section 15-27. Gas installer's license, bond, fee.
(a) Any person desiring to engage in the business of contracting for the installation, construction, reconstruction, adjustment or repairs of gas piping, gas appliances, fixtures or equipment or any changes thereto, shall first make application to the City Clerk for a gas installer's license. Such application shall be made on forms to be furnished by the City Clerk. The application shall be accompanied by a good and sufficient surety bond in the penal sum of two thousand dollars payable to the City, to be approved by the building department, conditioned that all gas piping, gas appliances, fixtures or equipment work by such person or his employees shall be in accordance with the requirements of this chapter and the gas installation rules and regulations of this city. Such bond shall save and keep harmless the City and all persons therein of and from all accidents, damages and loss which may accrue to the City or any of its inhabitants, by reason of failure to comply with this chapter or by reason of carelessness or negligence in connection with any such work. Before being issued such license the applicant will be required to pay the City Treasurer an annual license fee of fifteen dollars. ($15.00)
5. That Section 17-20 of the Code of Ordinances of the City of Grand Junction be amended to read as follows:
Section 17-20. Auctioneer's bond required.
A license shall not be issued to any auctioneer until he shall have given or unless he has given for the then current year a good and sufficient bond to the City in the sum of five hundred dollars ($500.) to be approved by the City Clerk and conditioned upon such auctioneer observing the laws of Colorado and the ordinances and charter of the City.
6. That Section 17-107 of the Code of Ordinances of the City of Grand Junction be amended to read as follows:
Section 17-107. Bond required.
Any person applying for a license to engage in the business of contracting for building, reconstructing or repairing cement sidewalks or curbing in the City under the provisions of Section 17-107 shall, at the time of making such application, execute to the City a good and sufficient bond, approved by the building department, in the sum of five hundred dollars, ($500) conditioned for the payment to said City, or to any property owner sustaining any damage, of the amount of any such damage sustained by said city or such property owner, not exceeding the amount of said bond, on account of the failure of such contractor properly to build, reconstruct or repair any cement sidewalk or curbing within the City in the manner provided by the ordinances of the City.
