ORDINANCE NO. 1271

 

AN ORDINANCE AMENDING SECTION 14-12 (A) OF THE CODE OF ORDINANCES OF THE CITY OF GRAND JUNCTION INCREASING THE RATES FOR REFUSE REMOVAL IN THE CITY AND AMENDING SECTION 14-10 (B) OF SAID CODE CONCERNING REFUSE CONTAINERS AND DECLARING AN EMERGENCY.

 

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION:

 

Section 1. That Section 14-12 (A) of the Code of Ordinances of the City of Grand Junction be amended to read as follows:

 

Section 14-12. FEES

 

(A) Collection at ground level and within 10 feet. The fees for collection and disposal of refuse placed for collection at ground level and not more than ten feet distant from the curb of the street or side of the alley from which collection is made shall be at the following monthly rates, collected monthly with the water bill as follows:

 

(1) Residential Rate. Includes all residential uses and "community facilities, non-commercial" as defined in the current city zoning ordinance.

 

(a) Single family dwellings: $1.75 per month for weekly collection of all refuse.

 

(b) Double or multi-family dwellings: The following rates shall apply for weekly collection of all refuse:

 

2 units . . . $2.80

3 units . . . 3.85

4 units . . . 4.90

5 units . . . 5.95

6 units . . . 7.00

7 units . . . 8.05

8 units . . . 9.10

 

In instances where multi-family residential uses have five or more units, owners may elect to be charged according to the commercial rate as set forth in paragraph (A) (2) (a) of this section.

 

(2) Commercial rate. Includes all assembly, institutional, business and commercial uses, except "community facilities, non-commercial," as defined in the current zoning ordinance.

 

(a) The minimum charge shall be $2.70 per month which shall provide weekly collection of up to 93 gallons of refuse. Rates for increased frequency of collection based on 93 gallons per pick-up shall be:

 

Once a week service . . .    $2.70

Twice a week service . . .     4.20

Three times a week service . . .   5.25

Five times a week service . . .   6.65

Six times a week service . . .   7.00

 

For each additional 31 gallons per pick up an additional charge of $0.35 shall be added to the monthly rate.

 

(b) Up to 31 gallons of refuse may be collected six times a week for a monthly charge of $5.60.

 

(c) Service for supermarkets requiring use of special trailers because of volume of refuse shall be provided at a monthly rate of $12.60 per time that the trailers are pulled each week plus a flat monthly amount of $0.50 for each one-tenth of a mile of distance from the supermarket to the disposal site for the trailer.

 

(d) Service for restaurants, cafes, cocktail lounges, etc. (all "restaurant business, limited" uses as defined in the current zoning ordinance) shall be provided at a monthly rate based on $2.70 for a kitchen and $0.07 for each customer seating capacity. Establishments under this rate shall be entitled to collection service six times per week.

 

(3) Industrial Rate. Includes all industry uses as defined in the current city zoning ordinance.

 

(a) The minimum charge shall be $3.15 per month which shall provide weekly collection of up to 93 gallons of refuse, not to exceed 150 pounds in weight.

 

(b) Additional service by frequency or volume may be provided individual industrial users on a cost basis determined upon consideration of the frequency, volume, weight, loading out difficulty, and nature of material to be disposed of.

 

Section 2. That Section 14-10 (B) of the Code of Ordinances of the City of Grand Junction be amended to read as follows:

 

Section 14-10. Precollection practices.

 

(B) Refuse containers.

 

(1) Nature and size of containers. All refuse containers (except containers for yard and garden clippings) must have handles and separate lids, must not exceed 31 gallons in capacity and, when filled, shall be of such weight that they may be handled and lifted by one man without stain. Oil drums, or parts thereof are not considered legal containers and must be removed from public rights-of-way.

 

(2) Duty to provide and maintain in sanitary condition. Refuse containers shall be maintained in good condition. Any container that does not conform to the provisions of this chapter or that may have ragged or sharp edges or any other defect liable to hamper or injure the person collecting the contents thereof shall be promptly replaced upon notice. The City Engineer shall have the authority to refuse collection services for failure to comply herewith.

 

(3) Ashes. Ash containers shall be made of metal and have a capacity of not more than ten gallons.

 

(4) Frontage pickup. Where there is frontage pickup, containers must be kept on the premises and off the right-of-way except on days of pickup.

 

Section 3. It is hereby declared that a special emergency exists and that this Ordinance is necessary for the preservation of the public peace, health and safety and shall take effect upon its passage.
