ORDINANCE NO. 1298

 AN ORDINANCE ADOPTING BY REFERENCE THE COLORADO MUNICIPAL ELECTION CODE OF 1965, A LEGISLATIVE ENACTMENT OF THE STATE OF COLORADO, EXCEPT AS TO THOSE SECTIONS AMENDED HEREIN AND ENACTED A AMENDED, AND ADOPTING THE PENALTY SECTION AS SET OUT IN SAID CODE.

 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION:

 1. That the Colorado Municipal Election Code of 1965, as enacted by the legislature of the State of Colorado, be, and the same is hereby, adopted by reference, subject, however, to amendment in the following particulars:

 a. Section 2 (5) is amended to read:

 "Regular election" means the municipal election held on the first Tuesday after the first Monday in April in each odd-numbered year."

 b. That Section 45 (b) is not enacted as a part of said Code and is specifically deleted therefrom.

 2. That Section 143 of said Code is hereby adopted, said section, the penalty section of said Code, reading as follows:

 Section 143.--Penalties for election offenses. In all cases where an offense is denominated by this act, as being a misdemeanor and no penalty is specified, the offender, upon conviction thereof, shall be punished by fine of not to exceed one thousand dollars - or by imprisonment in the county jail for not to exceed one year, or by both such fine and imprisonment.

 3. That all former ordinances or parts of ordinances in conflict with said Code are hereby repealed.

PASSED AND ADOPTED this 4th day of December, 1968.

Grand Junction do attest and affirm that they have read the Colorado Municipal Election Code of 1965 in its entirety and do hereby waive the reading of said Code as a part of its adoption by reference.
