ORDINANCE NO. 1331

AN ORDINANCE AMENDING SECTIONS 20-27 AND 20-28 (a) AND (b) OF THE CODE OF ORDINANCES OF THE CITY OF GRAND JUNCTION, CONCERNING THE USE OF LINCOLN PARK AND ITS FACILITIES AND CHARGES FOR SUCH USE.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION:

That the following Sections of the Code of Ordinances of the City of Grand Junction be amended to read as follows:

Section 20-27. Licenses to use authorized.

The City Council may grant a license to any responsible person, organization, firm or corporation for permission to use Lincoln Park and the facilities therein for public entertainments, the sale of food or other refreshments, ball games or any other athletic games or sports and public exhibitions; provided, the permittee shall agree to obey and conform to all rules and regulations made by the city council in reference to the care, management and government of city parks.

Section 20-28. Charge for license to use.

(a) Except as the City Council may by written agreement otherwise provide the person using Lincoln Park for purposes where an admission charge is made shall pay to the City the sum of twenty-five cents for each ticket sold when the price of said ticket, exclusive of the amount to be paid to the city, is twenty-five cents or greater. For the purposes of this section, school and college activity tickets shall be considered to be sold for in excess of twenty-five cents per admission. Where charges are made by licensees other than admission charges, there shall be paid by the licensee to the City fifteen per cent of the gross receipts derived from said charges which moneys shall be in addition to those required to be paid on admissions, if any.

(b) A minimum charge of twenty-five dollars ($25.00) for each use of the baseball field and for each use of the football field shall be paid by all licensees using such facilities except when such facilities are used for practice or non-spectator activities, and, when used for such purposes, charges shall be as agreed upon between the City Manager and the licensee for such use.
