ORDINANCE NO. 1369

 

AN ORDINANCE PROVIDING MINIMUM REQUIREMENTS FOR THE PROTECTION OF LIFE, LIMB, HEALTH, PROPERTY SAFETY, AND WELFARE OF THE GENERAL PUBLIC AND THE OWNERS AND OCCUPANTS OF RESIDENTIAL BUILDINGS; ADOPTING BY REFERENCE THERETO THE UNIFORM BUILDING CODE OF THE INTERNATIONAL CONFERENCE OF BUILDING OFFICIALS, 1970 EDITION, VOLUME III, (HOUSING) TOGETHER WITH THE APPENDICES THERETO; PROVIDING PENALTIES FOR THE VIOLATION THEREOF; REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH; AND PROVIDING FOR THE SUBMISSION OF ITS APPROVAL AND IMPLEMENTATION TO A VOTE OF THE REGISTERED ELECTORS OF THE CITY OF GRAND JUNCTION, COLORADO.

 

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:

 

1. Pursuant to the authority conferred by the laws of the State of Colorado and the Charter of the City of Grand Junction, Colorado, there is hereby adopted as the housing code of the City of Grand Junction, by reference thereto, the Uniform Building Code, 1970 Edition, Volume III, including the appendices thereto, published by the International Conference of Building Officials, 50 South Los Robles, Pasadena, California, all to have the same force and effect as though set forth herein in every particular.

 

2. Any and all sections or parts of sections of the Code of Ordinances of the City of Grand Junction, Colorado, as amended, in conflict or inconsistent herewith are hereby repealed.

 

3. A public hearing on the adoption by reference thereto of the Uniform Building Code, 1970 Edition, Volume III, (HOUSING) together with the appendices thereto, be, and the same hereby is scheduled in the City Auditorium in the City of Grand Junction, Colorado, at 7:30 o'clock P. M. on the 2nd day of September 1970, and the City Clerk is hereby directed to publish Notice of said public hearing in the manner and style and pursuant to the schedule of such publication prescribed in Colorado Revised Statutes 139-34-3 (1963).

 

4. At least three copies of the Uniform Building Code, 1970 Edition, Volume III (Housing), all certified to be true copies, shall be on file in the office of the City Clerk of the City of Grand Junction, Colorado, at least fifteen days preceding said hearing and may be inspected by any interested person between the hours of 8:00 A. M. and 5:00 P. M. Monday through Friday.

 

5. Any violation of the housing code of the City of Grand Junction, Colorado, from and after the effective date thereof shall be punishable by a fine not exceeding Three Hundred Dollars ($300) or imprisonment for a term not exceeding ninety (90) days, or by both such fine or imprisonment.

 

6. The City Council of the City of Grand Junction, Colorado, shall adopt this ordinance, which adopts by reference the housing code, in accordance with the procedure set out in Chapter 139-34-3 Colorado Revised Statutes (1963), and in accordance with those procedures set out in the Charter of the City of Grand Junction, Colorado; provided, however, the code shall not become effective nor be implemented until and unless it shall have been approved by a majority of the registered electors of the City of Grand Junction, Colorado, voting at a special election to be held as soon as practicable.

I HEREBY CERTIFY that the foregoing ordinance, being Ordinance No. 1369 was introduced, read, and ordered published by the City Council of the City of Grand Junction, Colorado, at a regular meeting of said body held on the 5th day of August, 1970, and that the same was published in The Daily Sentinel, a newspaper published and in general circulation in said City, at least ten days before its final passage.
