ORDINANCE NO. 1388
AN ORDINANCE AUTHORIZING THE CITY OF GRAND JUNCTION,
COLORADO, ACTING JOINTLY WITH THE COUNTY OF MESA
TO CREATE A PUBLIC AIRPORT AUTHORITY;
DESIGNATING THE MEMBERS OF THE BOARD OF COMMISSIONERS
OF THE AUTHORITY TO REPRESENT THE CITY ON SAID BOARD
AND THE TERMS THEREOF; AND DECLARING AN EMERGENCY
WHEREAS, the City of Grand Junction, Mesa County, Colorado, is a Charter City duly organized and existing under and pursuant to Article XX of the Constitution of the State of Colorado; and
WHEREAS, the Public Airport Authority Act, being Chapter 5, Article 5, C.R.S. 1963, as amended, provides, among other things, that any combination of one or more municipalities or one or more counties may create a Public Airport Authority for the purpose of acquiring and improving airports, air navigation facilities and related facilities, and the financing of the cost of such acquisitions by the issuance of bonds or other obligations of such Authority, payable from the income thereof, and otherwise secured to the extent permitted by law, without the inĀcurrance of an indebtedness by the State of Colorado, or by any of its political subdivisions, thereby promoting and facilitating transportation by air from or to points located within the State of Colorado, all to the benefit and general welfare of the State of Colorado, its political subdivisions and the inhabitants thereof; and
WHEREAS, the City Council of the City of Grand Junction, acting jointly with the Board of County Commissioners of Mesa County, Colorado, deem it necessary and desirable to create a Public Airport Authority; and
WHEREAS, on March 3, 1971, a public hearing on the creation of such Airport Authority was authorized, and notice of such hearing was directed to be published not less than ten days prior thereto; and
WHEREAS, this is the date, time and place of the public hearing; and WHEREAS, after hearing and considering all statements for and against the creation of a Public Airport Authority, by all those present at the heating, and after considering all pertinent facts and information available, the City Council is of the opinion that a Public Airport Authority, created jointly with the County of Mesa, would be a public benefit and in the best interests of the City and its inhabitants;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION:
Section 1. That the City of Grand Junction, acting jointly with the County of Mesa, be authorized and directed to create a Public Airport Authority pursuant to Chapter 5, Article 5, C.R.S. 1963, as amended, by filing with the Secretary of State a certified copy of this Ordinance after the same becomes effective.
Section 2. The name of the Public Airport Authority, having been concurred in by the County Commissioners of Mesa County, Colorado, is "Walker Field, Colorado, Public Airport Authority."
Section 3. That the members of the Board of Commissioners of the Airport Authority to represent the City on said Board, being taxpaying electors as defined in 49-1-4 (6) C.R.S. 1963, and residing in the City of Grand Junction are:
Richard G. Youngerman, Stanley Anderson, and Ray A. Meacham.
The terms of the members of the Board of Commissioners shall be four years, except that the terms of the members of the first Board, as designated herein, shall be adjusted so that the terms of one-half of the members (including the County members) shall expire two years thereafter. At the first meeting of the Board of the Authority, the Commissioners shall determine by lot which members shall serve for two-year terms and which shall serve for four-year terms.
Section 4. At the first meeting of the Board of Commissioners, there shall be adopted By-laws of the Authority, which By-Laws shall designate the officers of the Authority, the time and place for all regular meetings of the Board and shall prescribe the powers and duties of the officers and the Authority, not inconsistent with law, and other details in connection with the Airport Authority.
Section 5. The City Clerk shall be and she is hereby authorized and directed to file a certified copy of this Ordinance after the same becomes effective, with the Secretary of State of Colorado, and also to file with the said Secretary of State of Colorado, a joint certificate with the County Clerk of the County of Mesa, certifying that the City of Grand Junction, Colorado, and the County of Mesa, State of Colorado, are all of the counties and municipalities joining in the formation of the Authority.
Section 6. That if any one or more parts of this Ordinance shall be judicially declared invalid or inoperative, such designation shall not affect the remaining provisions hereĀof, the intention being that the provisions of this Ordinance are severable.
Section 7. All ordinances or parts thereof in conflict with this Ordinance are hereby repealed.
Section 8. By reason of the fact that the City desires immediately to create a Public Airport Authority in order to take advantage of favorable municipal bond market conditions thereby effecting substantial savings in interest costs to the City and its inhabitants, it is hereby declared that an emergency exists, that this ordinance is necessary to the immediate preservation of the public peace, health and safety, and that it shall be in full force and effect immediately upon its passage.

I HEREBY CERTIFY that the foregoing emergency ordinance, entitled AN ORDINANCE AUTHORIZING THE CITY OF GRAND JUNCTION, COLORADO, ACTING JOINTLY WITH THE COUNTY OF MESA TO CREATE A PUBLIC AIRPORT AUTHORITY; DESIGNATING THE MEMBERS OF THE BOARD OF COMMISSIONERS OF THE AUTHORITY TO REPRESENT THE CITY ON SAID BOARD AND THE TERMS THEREOF; AND DECLARING AN EMERGENCY was introduced, read, passed, and adopted as an emergency ordinance, numbered 1388 and ordered publisher by the unanimous vote of the members of the City Council of the City of Grand Junction, Colorado, at a regular meeting of said Council held on the 17th day of March, 1971.
