ORDINANCE NO. 1512

AN ORDINANCE OF THE CITY OF GRAND JUNCTION, COLORADO, AMENDING ITS ORDINANCE NO. 1500 WHICH ORDINANCE PROVIDED FOR CERTAIN OFF-STREET PARKING FACILITIES BY MEANS OF THE LEASING OF SUCH OFF-STREET PARKING FACILITIES BY THE CITY OF GRAND JUNCTION FROM THE GRAND JUNCTION, COLORADO, PARKING AUTHORITY, A COLORADO NON-PROFIT CORPORATION, FOR APPROVING THE FORM OF LEASEHOLD AGREEMENT WITH OPTION TO PURCHASE BETWEEN THE CITY AND SAID AUTHORITY FOR SAID PURPOSE, AND PROVIDING OTHER MATTERS RELATING THERETO; THIS AMENDMENT TO CHANGE THE MAXIMUM TERM OF THE LEASE AND THE OPTION DATE TO DECEMBER 31, 1991 INSTEAD OF DECEMBER 31, 1989.

WHEREAS, the City Council of the City of Grand Junction, Colorado, has heretofore passed Ordinance No. 1500 providing for certain off-street parking facilities by means of the leasing of such off-street parking facilities by the City of Grand Junction, Colorado, Parking Authority, a Colorado non-profit corporation, approving the form of Leasehold Agreement with Option to Purchase between the City and said Authority for said purpose, and providing other matters relating thereto;

WHEREAS, the City Council has determined that an Amendment is necessary to the proposed Leasehold Agreement with Option to Purchase authorized by said Ordinance No. 1500;

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:

1. The forms and contents of the "Leasehold Agreement with Option to Purchase" between the City of Grand Junction, Colorado, and Grand Junction, Colorado, Parking Authority, a Colorado non-profit corporation, attached to and incorporated in said Ordinance No. 1500 by reference is hereby amended by substituting the date "December 31, 1991" wherever the date "December 31, 1989" appears therein. This Amendment effects changes in the wording in Paragraphs 2, 4, 7 and 23 of said "Leasehold Agreement with Option to Purchase."

2. With the foregoing Amendment, this Ordinance confirms, adopts, and ratifies the authorizations, approvals, and other actions taken in said Ordinance No. 1500, as amended herein with the same effect as if the amendments made in this Ordinance had been originally set forth in said Ordinance No. 1500.

3. Wherever an Ordinance, Resolution or other document now or hereafter shall refer to said Ordinance No. 1500, it shall, in each case, be deemed to refer to said Ordinance No. 1500 as amended by this Ordinance, unless clearly made inapplicable.
