ORDINANCE NO. 1569

AN ORDINANCE VACATING A PORTION OF NORTH FIFTH STREET IN THE CITY OF GRAND JUNCTION

WHEREAS, the portion of North 5th Street in the City of Grand Junction has been petitioned for vacation, and

WHEREAS, such portion of street has not been opened or used as a street, the vacation thereof has been approved by the Planning Commission, and the vacation would not deprive any land of access;

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION:

That that portion of North 5th Street in the City of Grand Junction, Mesa County, Colorado, and described as:

Tract #1: As recorded in Book 802, Page 89 in Mesa County, Colorado.

Beg. at a point on the E line Bookcliff Heights Sub which is 922.27 ft E and 255 ft N of the SW Corner S 1/2 NE 1/4 NW 1/4, Sec 11, T1S, R1W, Ute Meridian, thence S along said E line 150 ft, thence E 25 ft thence N 150 ft, thence W 25 ft to point of beginning.

Tract #2: As recorded Book 791, Page 209, in Mesa County, Colorado.

Beg at a point 972.27 ft E and 340 ft N of the SW Corner S half NE quarter NW quarter Sec 11, T1S, R1W, Ute Meridian, which point is 340 ft N and 50 ft E of the SE corner of Bookcliff Heights Sub, thence Southwesterly by curve right, West/radius of 50 ft, 26.18 ft to a point which is 43.4 ft S and 25 ft W of said point of Beg, thence S 41.6 ft, thence W 25 ft, thence N 85 ft, thence E 50 ft to a point of beginning, also beg at a point 340 ft N and 1213.4 ft E of the SW corner S half NE quarter NW quarter Sec 11, T1S, R1W, Ute Meridian, thence S 85 ft, thence W 50 ft, thence N 85 ft, thence E 50 ft to the point of beginning.

Tract #3: As recorded in Book 791, Page 210, in Mesa County, Colorado.

Beg at a point 340 ft N and 972.27 ft E of the SW corner of the S half of the NE quarter of the NW quarter of Sec 11, T1S, R1W, Ute Meridian, thence Northwesterly along a 50 ft radius curve to the left 78.5 ft to a point 50 ft N and 50 ft W of the point of Beg, thence S 50 ft, thence E 50 ft to the point of beginning.

be vacated, subject to easements for existing utilities.
