ORDINANCE NO. 1613

 

AN ORDINANCE ESTABLISHING A SYSTEM FOR PROVIDING WRECKER SERVICE AT ACCIDENT SCENES; REQUIRING CERTAIN ACTION BY WRECKERS AT SUCH SCENE, AND PROVIDING FOR THE REMOVAL OF THE PRIVILEGE OF COVERING ACCIDENTS BY WRECKERS.

 

WHEREAS, problems have arisen in the City in connection with the use of wrecker service at the scene of automobile accidents within the City; and

 

WHEREAS, the City Council believes that some regulation is necessary and will eliminate the problems:

 

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION:

 

1. That Chapter 30 of the Code of Ordinances of the City of Grand Junction be amended by the addition thereto of an Article IV which shall read as follows:

 

ARTICLE IV

 

Wrecker Service

 

Section 30-75. Control of Service at Accident Scene.

 

(A) It shall be unlawful for a wrecker service operator, his agent or driver to go to the scene of an automobile accident in the City of Grand Junction unless called by the owner or operator of a vehicle damaged in the accident or by the Police Department under its rotation system.

 

(B) Wrecker services holding Public Utilities Commission permits, and having their business office and storage yard in the City of Grand Junction, may get on the rotation list at the Police Department by registering there and leaving current copies of their tariffs as filed with the Public Utilities Commission. Calls for wrecker service at accidents shall then be made from the list, in rotation, as such service is required by those operators of vehicles who have no personal preference for the service.

 

(C) A wrecker service shall be removed from the rotation list if, in the opinion of the Chief of Police, such action is warranted because of overcharging by the particular service, failure to properly clean the accident area of debris, complaints on quality of service performed, and, in addition to the remedy of criminal prosecution for failure to adhere to the rotation method of accident coverage, removal may also be made for such offense.

 

Section 30-76. Cleanup at Scene.

 

It shall be the responsibility of the wrecker service or services called to the scene of an automobile accident within the City, whether called under the rotation system or by the owner or operator of a vehicle involved in the accident, to clear the scene of the accident of all glass and debris resulting from the accident to the satisfaction of the police officer at the scene.

 

2. This Ordinance shall take effect on the first day of April, 1976.
