ORDINANCE NO. 1743

 

AN ORDINANCE PRESCRIBING REGULATIONS CONSISTENT WITH NATIONALLY RECOGNIZED GOOD PRACTICE FOR THE SAFEGUARDING TO A REASONABLE DEGREE OF LIFE AND PROPERTY FROM THE HAZARDS OF FIRE AND EXPLOSION ARISING FROM THE STORAGE, HANDLING AND USE OF HAZARDOUS SUBSTANCES, MATERIALS AND DEVICES, AND FROM CONDITIONS HAZARDOUS TO LIFE OR PROPERTY IN THE USE OR OCCUPANCY OF BUILDINGS OR PREMISES IN THE CITY OF GRAND JUNCTION, COLORADO; ADOPTING BY REFERENCE THERETO THE UNIFORM FIRE CODE OF THE INTERNATIONAL CONFERENCE OF BUILDING OFFICIALS AND WESTERN FIRE CHIEFS ASSOCIATION, 1976 EDITION TOGETHER WITH THE APPENDICES THERETO; PROVIDING PENALTIES FOR THE VIOLATION THEREOF; AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH.

 

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:

 

1. Pursuant to the authority conferred by the laws of the State of Colorado and the Charter of the City of Grand Junction, Colorado, there is hereby adopted as the fire code of the City of Grand Junction, by reference thereto, the Uniform Fire Code, 1976 Edition, including the Appendices thereto, published by the International Conference of Building Officials and the Western Fire Chiefs Association, both of 5360 South Workman Mill Road, Whittier, California 90601, all to have the same force and effect as though set forth herein in every particular.

 

2. A public hearing on the adoption by reference thereto of the Uniform Fire Code, 1976 Edition, together with the Appendices thereto, be and the same hereby is scheduled in the City Council Chambers in the City of Grand Junction, Colorado, at 7:30 o'clock P.M. on the 7th day of June, 1978, and the City Clerk is hereby directed to publish Notice of said public hearing in the manner and style and pursuant to the schedule of such publication prescribed in Colorado Revised Statutes 31-12-403 (1973).

 

3. At least three copies of the Uniform Fire Code, 1976 Edition, all certified to be true copies, shall be on file in the Office of the City Clerk of the City of Grand Junction, Colorado, at least fifteen days preceding said hearing and may be inspected by any interested person between the hours of 8:00 A.M. and 5:00 P.M. Monday through Friday.

 

4. Amendments to the Uniform Fire Code are as follows:

 

(a) Appendix C to the Uniform Fire Code is deleted;

 

(b) Section 13.315 is amended to read as follows:

 

Fire-extinguishing Equipment for Protection of Hood and Duct Ventilation Systems and Related Cooking Appliances

 

Sec. 13-315. Commercial type cooking equipment, from which grease-laden vapors emanate in normal cooking application and where the Chief determines that such grease-laden vapors constitute a fire hazard, shall be protected by a approved automatic extinguishing system; provided, however, such requirement shall not have retroactive application except where remodeling or repair is being done in the cooking area, which remodeling or repair requires the issuance of a building permit.

 

EXCEPTION: That portion of the fire-extinguishing system required for the protection of the duct may be omitted when approved grease extractors are installed.

 

The design and installation of such fire-extinguishing system shall be in accordance with the provisions of Chapter 20, Uniform Mechanical Code, or NFPA 96-1973. Extinguishing systems shall be serviced at least every 12 months or after any activation of the system. Hoods, ducts, filters and fan housings shall be cleaned at sufficient intervals to prevent the accumulation of grease therein.

 

5. Any violation of the fire code of the City of Grand Junction, Colorado, from and after the effective day thereof shall be punishable by a fine not exceeding three hundred dollars ($300.00) or imprisonment for a term not exceeding ninety (90) days, or by both such fine or imprisonment.

 

6. Any and all sections or parts of section of the Code of Ordinances of the City of Grand Junction, Colorado, as amended, in conflict and inconsistent herewith are hereby repealed.
