ORDINANCE NO. 1789

AN ORDINANCE AMENDING THE CHARGES FOR USE OF THE STADIA IN LINCOLN PARK.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION:

That Section 20-28 of the Code of Ordinances of the City of Grand Junction be amended to read as follows:

"Sec. 20-28 Charge for License to Use.

(a) Except as the city may by written agreement otherwise provide the person using Lincoln Park for purposes where an admission charge is made shall pay to the city the sum of thirty-five cents ($0.35) for each ticket sold when the price of said ticket, exclusive of the amount to be paid to the city, is thirty-five cents ($0.35) or greater; provided, however, that for the national Junior College Athletic Association tournament and for state championship play-off games for School District No. 51 under the auspices of the state activities association, a charge of only two hundred fifty dollars ($250.00) per day shall be made for the use of the Lincoln Park facilities, except that when the city is forced to special expense in aid of such activity, there shall be charged, in addition to the per day charge, an amount to compensate for time of workmen and materials provided by the city. For the purpose of this section, school and college activity tickets shall be considered to be sold for in excess of thirty-five cents ($0.35) per admission. Where charges are made by licensees other than admission charges, there shall be paid by the licensee to the city fifteen (15) per cent of the gross receipts derived from said charges which moneys shall be in addition to those required to be paid on admissions, if any.

(b) A minimum charge of thirty-five dollars ($35.00) for each use of the baseball field and for each use of the football field shall be paid by all licensees using such facilities except when such facilities are used for practice or non spectator activities, and, when used for such purposes, charges shall be as agreed upon between the city manager and the licensee for such use. A double header shall be considered two (2) uses."
