ORDINANCE NO. 1909

 

AN ORDINANCE VACATING RIGHT OF WAY IN THE CITY.

 

WHEREAS, the portion of right of way hereinafter described has been petitioned for vacation; and

 

WHEREAS, such vacation has been approved by the Planning Commission, would not deprive anyone of access to property and would not be detrimental to the inhabitants of the City of Grand Junction;

 

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION:

 

That the following portion of right of way within the City of Grand Junction, Mesa County, Colorado, to wit:

 

A tract of land situated in Section 36, township 1 North, Range 1 West, Ute Meridian, being a part of Horizon Court as dedicated on Horizon/70 Subdivision as recorded in Book 12, Page 76, Mesa County Clerk & Recorder's Office, and being described as follows: Beginning at the Northeast Corner of Lot 1; thence North 27 deg. 20 min. 00 sec. East 49.09 feet; thence 43.82 feet along the arc of a curve to the right with a radius of 206.00 feet and a chord of North 05 deg. 14 min. 06 sec. West 43.74 feet; thence North 00 deg. 51 min. 34 sec. East 22.50 feet; thence 3.79 feet along the arc of a curve to the left with a radius of 128.00 feet and a chord of North 00 deg. 00 min. 41 sec. East 3.79 feet; thence South 41 deg. 29 min. 41 sec. West 60.04 feet to the North Corner of Lot 1 Horizon/70 Subdivision; thence 67.49 feet along the arc of a curve to the left with a radius of 50.00 feet and a chord of South 11 deg. 20 min. East 62.48 feet; thence South 50 deg. 00 min. East 11.24 feet to the point of beginning, being subject to a 10 foot easement over and across above described property, said easement being along the Easterly side of above described parcel and lying 10 feet Westerly of the East line of the above described parcel. East 60.04 feet; thence 45.73 feet along the arc of a curve to the left with a radius of 128.00 feet and a chord of North 11 deg. 04 min. 19 sec. West 45.49 feet; thence 39.96 feet along the arc of a curve to the right with a radius of 40.00 feet and a chord of South 03 deg. 00 min. 54 sec. West 32.95 feet; thence South 27 deg. 20 min. 63.84 feet to the point of beginning.

 

be and the same is hereby vacated, and added to Lot 1, Horizon/70 Subdivision.
