ORDINANCE NO. 1947

AN ORDINANCE VACATING RIGHT OF WAY AND EASEMENT WITHIN THE CITY.

Whereas, the portion of right of way and easement hereinafter described has been petitioned for vacation; and

Whereas, such vacation has been approved by the Planning Commission, would not deprive anyone of access to property, and would not be detrimental to the inhabitants of the City of Grand Junction;

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION:

That the following portion of right of way within the City of Grand Junction, Mesa County, Colorado, to wit:

A portion of Ridge Drive, Pheasant Run, Spring Valley Filing No. Six, being more particularly described as follows: Beginning at the NW Corner of Lot 42, Block 7, Pheasant Run, Spring Valley Filing No. Six; thence North 00 deg. 00 min. 59 sec. East, 38.57 feet along the West line of the SE 1/4 of the NE 1/4 of Section 1 T1S, R1W, Ute Meridian, to a point on a non-tangent curve, thence 117.45 feet along the arc of a curve to the left, the radius of which is 430.00 feet, the interior angle of which is 15 deg. 39 min. 00 sec., the chord of which bears South 60 deg. 04 min. 01 sec. East, 117.09 feet, and the radius point of which bears North 37 deg. 44 min. 50 sec. East, to a point on a non-tangent curve and the north line of said Lot 42; thence 104.05 feet along the North line of said Lot 42, which is the arc of a curve to the left, the radius of which is 270.00 feet, the interior angle of which is 22 deg. 04 min. 51 sec. the chord of which bears North 78 deg. 56 min. 34 sec. West 103.41 feet, and the radius point of which bears South 22 deg. 05 min. 30 sec. West; to the point of beginning;

and the following easement within the City of Grand Junction, Mesa County, Colorado, to wit:

The Northerly 10 foot utility easement in Lot 42, Block 17, of said subdivision except the Westerly 15 feet thereof and except the Easterly 10 feet thereof,

be and the same are hereby vacated.

I HEREBY CERTIFY that the foregoing ordinance, being Ordinance No. 1947, was introduced, read, and ordered published by the City Council of the City of Grand Junction, Colorado, at a regular meeting of said body held on the 18th day of February, 1981, and that the same was published in The Daily Sentinel, a newspaper published and in general circulation in said City, at least ten days before its final passage.
