ORDINANCE NO. 1999

AN ORDINANCE VACATING A ROAD RIGHT OF WAY AND DRAINAGE EASEMENT WITHIN THE CITY.

WHEREAS, the road right of way and drainage easement hereinafter described have been petitioned for vacation; and

WHEREAS, such vacations have been approved by the Planning Commission, would not deprive anyone of access to property and would not be detrimental to the inhabitants of the City of Grand Junction;

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION:

That the following road right of way and drainage easement within the City of Grand Junction, Mesa County, Colorado, to wit:

Right of Way:

A portion of the right of ways of Nine Iron Drive and Niblic Drive located in the Southwest Quarter of the Southeast Quarter of Section 36, Township 1 North, Range 1 West of the Ute Meridian, said right of way being more particularly described as follows: Commencing at the Northwest Corner of the Southwest Quarter of the Southeast Quarter of said Section 36; thence North 90 deg. 00 min. 00 sec. East along the North line of the Southwest Quarter of the Southeast Quarter of said Section 36 a distance of 504.54 feet; thence South 45 deg. 00 min. 00 sec. East 182.41 feet; thence North 90 deg. 00 min. 00 sec. East 39.65 feet to the TRUE POINT OF BEGINNING; thence along the arc of a curve to the left whose radius is 75.00 feet and whose long chord bears South 45 deg. 00 min. 00 sec. West 106.7 feet; thence North 00 deg. 00 min. 00 sec. East 75.00 feet; thence North 90 deg. 00 min. 00 sec. East 75.00 feet to the TRUE POINT OF BEGINNING,

Drainage Easement:

A portion of roadway dedicated on the plat of Partee Heights Subdivision, then vacated by City of Grand Junction Ordinance 1823 as recorded August 8, 1979, in Book 1213 at Page 199 of Mesa County Records and re-designated as a drainage easement, said easement being more particularly described as follows: Commencing at the Northwest Corner of the Southwest Quarter of the Southeast Quarter of Section 36, Township 1 North, Range 1 West of the Ute Meridian; thence North 90 deg. 00 min. 00 sec. East along the North line of the Southwest Quarter of the Southeast Quarter of said Section 36 a distance of 469.18 feet to the TRUE POINT OF BEGINNING: thence continuing North 90 deg. 00 min. 00 sec. East 70.71 feet; thence South 45 deg. 00 min. 00 sec. East 182.41 feet; thence South 90 deg. 00 min. 00 sec. West 707.71 feet; thence North 45 deg. 00 min. 00 sec. West 182.41 feet to the TRUE POINT OF BEGINNING,

be and the same are hereby vacated.
