ORDINANCE NO. 2009

AN ORDINANCE PROHIBITING SMOKING IN THEATERS.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION:

That Chapter 19 of the Code of Ordinances of the City of Grand Junction is amended by the addition of a Section 77 to read as follows:

"Section 19-77. Smoking prohibited in certain public places.

Smoking, which for the purposes of this ordinance is defined as meaning the carrying of a lighted pipe, lighted cigar, or lighted cigarette of any king and includes the lighting of a pipe, cigar, or cigarette of any king, is prohibited in the following public places:

1. Any building used or designed primarily for the purpose of exhibiting any motion picture, stage drama, lecture, musical recital or other such performance whenever open to the public; except that smoking shall be allowed in an area commonly referred to as a lobby if such lobby is reasonably separated from the spectator area."
