ORDINANCE NO. 2040

AN ORDINANCE VACATING EASEMENTS IN THE CITY.

WHEREAS, the easements, hereinafter described have been petitioned for vacation; and

WHEREAS, such vacations have been approved by the Planning Commission, would not deprive anyone of access to property and would not be detrimental to the inhabitants of the City of Grand Junction;

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION:

That the easements situate in the City of Grand Junction, County of Mesa and State of Colorado, and described as:

Easement granted to City of Grand Junction by instrument recorded August 14, 1967 in Book 912 at Page 608 over the West 15 feet of Beginning 303.5 feet South of the Northeast corner of Section 11, Township 1 South, Range 1 West of the Ute Meridian, thence West 200 feet, thence South 120 feet, thence East 200 feet, thence North to beginning, Together with the right of ingress and egress for proper repair and maintenance thereof. During the period of construction and installation of such Sanitary Sewer, the City of Grand Junction is granted the privilege of using a strip of land 15 feet in width and immediately adjacent to the East side of the above described easement.

Easement for sewer line described as follows: Beginning 423.5 feet South and 185 feet West of the Northeast corner of Section 11, Township 1 South, Range 1 West of the Ute Meridian, thence West 15 feet, thence South 55 feet, thence East 35 feet, thence North 20 feet, thence West 20 feet, thence North 35 feet; And a 15 foot easement over and across the following property, the center line of which is described as follows: Beginning at a point 453 feet South and 200 feet West of the Northeast corner of Section 11, Township 1 South, Range 1 West of the Ute Meridian, thence North 64 deg. 55 min. West 66.25 feet, more or less to a point on the West line of the Jess W. Trammel Tract as described in Book 394 at Page 472, Reception No. 399019 recorded June 8,1942 County Clerk Records, Mesa County, Colorado. Said center line point being 121.50 feet from the Northwest corner of said tract. Together with the right of ingress and egress for the proper repair and maintenance for said sewer line.

Easement for sewer construction and maintenance under, across, over and above the following described tracts: Beginning 423.5 feet South and 185.00 feet West of the Northeast corner of Section 11, Township 1 South, Range 1 West, Ute Meridian, thence West 15.00 feet, thence South 55.00 feet, thence East 35.00 feet, thence North 51 deg. 20 min. 20 sec. West 32.02 feet, thence North 35.00 feet to the point of beginning and also:

Easement granted to City of Grand Junction by instrument recorded August 15, 1967 in Book 912 at Page 612 over the West 15 feet of Beginning 203.5 feet South of the Northeast corner of NE1/4 NE1/4 of Section 11, Township 1 South, Range 1 West of the Ute Meridian, thence West 200 feet, thence South 100 feet, thence East 200 feet, thence North 100 feet to point of beginning, together with right of ingress and egress for proper repair and maintenance thereof. During the period of construction and installation of such Sanitary Sewer, the City of Grand Junction is granted the privilege of using a strip of land 15 feet in width and immediately adjacent to the East side of above described easement.

Beginning at a point 445.30 feet South and 200.00 feet West of the Northeast corner of Section 11, Township 1 South, Range 1 West, Ute Meridian, said point of beginning being 141.50 feet South of the Northeast corner of the Jess W. Trammel tract as described in Book 394, Page 472, Reception No. 399019, Recorded June 8, 1942, County Clerk's Records, Mesa County, Colorado. Thence South 16.56 feet, thence North 64 deg. 55 min. West 66.25 feet to a point on the West line of the said tract, thence North 16.56 feet along said West line to a point 113.42 feet South of the Northwest corner of the said tract, thence South 64 deg. 55 min. East 66.25 feet to the point of beginning.

be and the same are hereby vacated.
