ORDINANCE NO. 2073

 

AN ORDINANCE CONCERNING THE CONSUMPTION OF BEER AND LIQUOR IN PUBLIC PLACES.

 

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION:

 

That Section 29 of Chapter 19 of the Code of Ordinances of the City of Grand Junction is amended to read as follows:

 

"Sec. 19-29. Drinking of alcoholic beverages prohibited in certain places.

 

It shall be unlawful for any person to drink malt, vinous or spirituous liquor in the City in any public place including any public street,road, highway, alley or public way which is either publicly OWNED or privately owned and used by the Public except a person eighteen (18) years of age or older may drink 3.2 percent beer on the grassed areas of a public park unless otherwise prohibited by appropriate notice; the fact that a person is in or upon a motor vehicle at the time of such drinking shall not be a defense in prosecution under this Section; PROVIDED, HOWEVER, THAT SUCH RESTRICTIONS SHALL NOT APPLY WHEN SUCH PUBLIC PLACE IS A PART OF THE PREMISES DESIGNATED UNDER A VALID LICENSE ISSUED PURSUANT TO THE COLORADO BEER CODE."
