ORDINANCE NO. 2113

AN ORDINANCE RELATING TO THE REGULATION OF GAS PIPING, VENTING AND INSTALLATION OF GAS PIPING, VENTING AND INSTALLATION OF GAS, PROPANE, BUTANE, OIL FIRED AND CERTAIN SOLID FUEL APPLIANCES, AND AIR CONDITIONING AND AIR HANDLING EQUIPMENT IN BUILDINGS OR STRUCTURES WITHIN THE CITY OF GRAND JUNCTION, COLORADO; ADOPTING BY REFERENCE THERETO THE UNIFORM MECHANICAL CODE OF THE INTERNATIONAL CONFERENCE OF BUILDING OFFICIALS; AND THE INTERNATIONAL ASSOCIATION OF PLUMBING AND MECHANICAL OFFICIALS, 1982 EDITION, TOGETHER WITH APPENDIX THERETO, WITH CERTAIN AMENDMENTS THERETO; PROVIDING PENALTIES FOR THE VIOLATION THEREOF; AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:

(A) Pursuant to the authority conferred by the laws of the State of Colorado and the Charter of the City of Grand Junction, Colorado, there is hereby adopted a Mechanical Code of the City of Grand Junction by reference thereto, the Uniform Mechanical Code, 1982 Edition, including the Appendix thereto, with certain amendments thereto, published by the International Conference of Building Officials, 5360 Workmen Mill Road, Whittier, California, 90601, and the International Association of Plumbing and Mechanical Officials, 5032 Alhambra Avenue, Los Angeles, California, 90032, all to have the same force and effect as though set forth herein in every particular.

(B) Amendments:

1. Table 3-A is amended to read as follows:

1. For the issuance of each permit . . . $3.00

2. Any Gas, Propane, Butane or Oil Fired appliance less than 200,000 BTUH . . . $5.00

3. Gas, Propane, Butane or Oil Fired appliance 200,000 BTUH or more . . . $8.00

4. Any air Conditioner or Air Handling system . . . $6.00

5.Inspections outside of normal business hours . . . $15.00

6. Reinspection Fees reassessed under the provisions of Section 305(f) . . . $15.00

2. Amend Section 508 to include the following sentence:

GAS, PROPANE, BUTANE OR OIL FIRED APPLIANCES SHALL NOT BE INSTALLED UNDER ANY STAIR OR STAIR LANDING.

3. Amend Section 807(c) "Unvented" as follows: (Add after first sentence)

EXCEPTION: PORTABLE KEROSENE HEATERS IN GROUP R OCCUPANCIES.

(C) A public hearing on the adoption by reference thereto of the Uniform Mechanical Code, 1982 Edition, including the Appendix thereto, with certain amendments thereto, and the same hereby is scheduled in the City Council Chambers of the City of Grand Junction, Colorado, at 7:30 P.M. on the 16th day of March 1983, and the City Clerk is hereby directed to publish Notice of said public hearing in the manner and style and pursuant to the schedule of such publication prescribed in Colorado Revised Statutes 31-16-201.

(D) At least three copies of the Uniform Mechanical Code, 1982 Edition, together with Appendix thereto, with certain amendments thereto, all certified to be true copies, shall be on file in the office of the City Clerk of the City of Grand Junction, Colorado, at least fifteen (15) days preceding said hearing and may be inspected by any interested person between the hours of 8:00 A.M. and 5:00 P.M., Monday through Friday.

(E) Any violation of the mechanical code of the City of Grand Junction, Colorado, from and after the effective date thereof shall be punishable by a fine not exceeding three hundred dollars ($300.00) or imprisonment for a term not exceeding ninety (90) days, or by both such fine and imprisonment.

(F) Any and all sections or parts of sections of the Code of Ordinances of the City of Grand Junction, Colorado, as amended, in conflict or inconsistent herewith, are hereby repealed.

(F) This Ordinance shall become Section 18.25-1 and 2 of the Code of Ordinances of the City of Grand Junction.
