ORDINANCE NO. 2115

 

AN ORDINANCE VACATING A RIGHT-OF-WAY IN THE CITY.

 

WHEREAS, the right-of-way hereinafter described has been petitioned for vacation; and

 

WHEREAS, such vacation has been approved by the Planning Commission, would not deprive anyone of access to property and would not be detrimental to the inhabitants of the City of Grand Junction;

 

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION:

 

That the following right-of-way within the City of Grand Junction, Mesa County, Colorado, to wit:

 

A parcel of land situate in the Northeast Quarter of Section 12, Township 1 South, Range 1 West of the Ute Meridian, being more particularly described as follows: Beginning at the Northeast Corner of Lot 4, Block No. 2 of Mel Rose Estates Subdivision as recorded in Book 9 at Page 188 in the office of the Clerk and Recorder, Mesa County, Colorado; thence South 88 deg. 00 min. 00 sec. East 30.02 feet to the East line of the Northeast Quarter of said Section 12; thence South 00 deg. 02 min. 00 sec. East along said East line of the Northeast Quarter of said Section 12 a distance of 127.92 feet; thence North 89 deg. 56 min. 00 sec. West 55.04 feet to the point of curve on the South line of said Lot 4; thence along the arc of a curve to the left the radius of which is 25.00 feet and whose long chord bears North 45 deg. 01 min. 00 sec. East a distance of 35.39 feet to the East line of said Lot 4; thence North 00 deg. 02 min. 00 sec. West along said East line of said Lot 4 a distance of 103.89 feet to the Point of Beginning;

A parcel of land situate in the West Quarter of the Southwest Quarter of the Northwest Quarter of Section 7, Township 1 South, Range 1 East of the Ute Meridian, being more particularly described as follows: Commencing at the West Quarter Corner of said Section 7; thence North 00 deg. 02 min. 00 sec. West along the West line of the Northwest Quarter of said Section 7 a distance of 860.00 feet to the true point of beginning of said parcel; thence continuing North 00 deg. 02 min. 00 sec. West along said West line of the Northwest Quarter of Section 7 a distance of 61.53 feet to a point on the Southerly line of a drainage easement recorded in Book 1316 at Page 11 in the office of the Clerk and Recorder, Mesa County, Colorado; thence North 43 deg. 40 min. 00 sec. East along said Southerly easement line a distance of 43.42 feet; thence South 00 deg. 02 min. East 296.51 feet to the Northwest Corner of Lot 8, Block One Cindy Ann Subdivision; thence North 89 deg. 51 min. 30 sec. West 5.00 feet; thence North 00 deg. 02 min. 00 sec. West 203.53 feet; thence North 89 deg. 56 min. 00 sec. West 25.00 feet to the true point of beginning,

 

be and the same is hereby vacated.
