ORDINANCE NO. 2138

 

AN ORDINANCE VACATING A UTILITY EASEMENT IN THE CITY OF GRAND JUNCTION

 

WHEREAS, the utility easement hereinafter described has been petitioned for vacation; and

 

WHEREAS, such vacation has been approved by the Grand Junction Planning Commission and would not be detrimental to the inhabitants of the City of Grand Junction;

 

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION:

 

That the utility easement described as follows:

 

LEGAL DESCRIPTION of a parcel of land, said parcel being a portion of an easement, with said parcel being described herein for purposes of being vacated as an easement.

 

A parcel of land lying in the Northeast Quarter of the Southwest Quarter of the Southwest Quarter of Section 7, Township 1 South, Range 1 East of the Ute Meridian, City of Grand Junction, County of Mesa, State of Colorado, said parcel also being a portion of Tract "A" of Briargate Subdivision, as filed on page 79 of Book 13 of the records of the County of Mesa, said parcel being more particularly described as follows:

 

Commencing at the northeast corner of Briargate Subdivision, which point is also the northeast corner of Block Two of Eastgate Plaza, Filing No. One; thence S 90 deg. 00 min. 00 sec. W along the north boundary line of said Briargate subdivision, which line is also the Basis of Bearing, a distance of 108.34 feet; thence S 00 deg. 16 min. 46 sec. W a distance of 22.81 feet to the Point of Beginning, which point is also the northeast property corner of Lot 6 of Briargate Subdivision; thence S 89 deg. 43 min. 14 sec. E a distance of 22.50 feet; thence S 00 deg. 16 min. 46 sec. W a distance of 35.21 feet; thence N 89 deg. 43 min. 14 sec. W a distance of 22.50 feet to the southeast corner of said Lot 6; thence N 00 deg. 16 min. 46 sec. E along the easterly property line of Lot 6 a distance of 35.21 feet to the Point of Beginning.

Commencing at the southeast corner of Briargate Subdivision, which point is also the southeast corner of Block Three of Eastgate Plaza, Filing No. One; thence N 89 deg. 58 min. 45 sec. W along the south boundary line of said Briargate Subdivision, which line is also the Basis of Bearing, a distance of 108.88 feet; thence N 00 deg. 09 min. 55 sec. E a distance of 16.39 feet to the Point of Beginning, which point is also the southeast property corner of Lot 16 of Briargate Subdivision; thence N 00 deg. 09 min. 55 sec. E along the easterly line of said Lot 16, a distance of 35.20 feet to the northeast corner of said Lot 16; thence S 89 deg. 50 min. 05 sec. E a distance of 22.50 feet; thence S 00 deg. 09 min. 55 sec. W a distance of 35.20 feet; thence N 89 deg. 50 min. 05 sec. W a distance of 22.50 feet to the Point of Beginning.

 

be and the same is hereby vacated.
