ORDINANCE NO. 2150

 

AN ORDINANCE AMENDING ORDINANCE NO. 2012 OF THE CITY IN WHICH CERTAIN RIGHTS-OF-WAY AND EASEMENTS WERE VACATED IN ORCHARD MESA HEIGHTS SUBDIVISION.

 

WHEREAS, by Ordinance No. 2012, the City Council attempted to vacate certain rights-of-way and easements in Orchard Mesa Heights Subdivision; and

 

WHEREAS, the rights-of-way and easements need to be more clearly described, and dedication has to occur to replace the right-of-way and easement structure of the subdivision:

 

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION:

 

1. That the following rights-of-way and easements in Orchard Mesa Heights, Mesa County, Colorado, be vacated to wit:

 

Road Vacation - Laveta Street:

 

Commencing at the Southwest Corner of Lot 19, Block 9, Orchard Mesa Heights; thence South 90 deg. 00 min. 00 sec. East along the South line of Lot 19, Block 9, a distance of 139.80 feet to the TRUE POINT OF BEGINNING: thence North 00 deg. 06 min. 55 sec. East 350.03 feet; thence North 89 deg. 56 min. 15 sec. East 25.00 feet; thence South 00 deg. 06 min. 55 sec. West 25.00 feet, thence North 89 deg. 56 min. 43 sec. East 25.00 feet, thence South 00 deg. 06 min. 55 sec. West 325.08 feet; thence North 90 deg. 00 min. 00 sec. West 50.00 feet to the TRUE POINT OF BEGINNING.

 

Alley Vacation - Block 9:

 

The South 199.00 feet of the 20 foot alley parallel to and West of Laveta Street between Santa Clara Avenue and Unaweep Avenue;

 

Alley Vacation, Block 10:

 

The South 169.00 feet of the 20-foot alley parallel to and East of Laveta Street between Santa Clara Avenue and Unaweep Avenue;

 

Sanitary Sewer Easement Vacation:

 

An easement 20 feet wide as per document recorded in the office of the Mesa County Clerk & Recorder in Book 1021 at Page 668, the centerline of which is described as follows: Beginning at a point 1.5 feet South of the Northwest Corner of Lot 16, Block 9, Orchard Mesa Heights from whence the Southwest Corner of Lot 19, Block 9 of said Orchard Mesa Heights bears South 00 deg. 06 min. 55 sec. West 98.47 feet; thence North 75 deg. 07 min. 44 sec. East 144.72 feet to a point on the West right-of-way of Laveta Street. The side lines of said 20-feet easement to be extended or shortened and to terminate at said West right-of-way; AND

 

An easement 20 feet wide as per document recorded in the office of the Mesa County Clerk and Recorder in Book 1020 at Page 458, the centerline of which is described as follows: Beginning at a point on the East line of Lot 27, Block 10, Orchard Mesa Heights, 14.1 feet South of the Northeast Corner of said Lot 27 and from whence the Southeast Corner of Lot 20, Block 10, Orchard Mesa Heights bears South 00 deg. 06 min. 55 sec. West 186.03 feet; thence South 75 deg. 07 min. 44 sec. West 35.36 feet to point "A"; thence continuing South 75 deg. 07 min. 44 sec. West 109.36 feet to a point on the East right-of-way of Laveta Street. The side lines of said 20-foot easement to be extended or shortened and to terminate at said East right-of-way; AND

 

An easement 20 feet wide as per document recorded in the office of the Mesa County Clerk and Recorder in Book 1077 at Page 293, the centerline of which is described as follows: Beginning at the hereinabove described point "A"; thence South 32 deg. 23 min. 46 sec. East 63.55 feet to a point on the East line of Lot 24, Block 10, Orchard Mesa Heights. The side lines to be extended or shortened and to terminate at said East line.

 

All in accordance with Vacation Map, Exhibit A, attached hereto and made a part hereof.

 

2. This Ordinance shall become effective upon the recordation of a dedication of the rights-of-way and easements in Orchard Mesa Heights as they appear on Dedication Map, Exhibit B, attached hereto and made a part hereof.
