ORDINANCE NO. 2166
AN ORDINANCE ASSESSING CERTAIN PROPERTIES FOR IMPROVEMENTS UNDERTAKEN IN IMPROVEMENT DISTRICT NO. ST-82, PHASES A, B AND C IN THE CITY OF GRAND JUNCTION.
WHEREAS, the City Council on the 7th day of December, 1983, adopted Ordinance No. 2156 providing for the assessment of properties within Improvement District No. ST-82, Phases A, B and C, within the City of Grand Junction; and
WHEREAS, it was provided that there were properties within the District which were not assessed within that Ordinance as there was dispute as to them; and
WHEREAS, the City Council has now determined the action to be taken as to these lands, and as to the disputed assessments, FINDS:
1. As to the contention of Pioneer Steel Tube Distributors, Inc. claim that someone other than the company should pay the assessment, the City Council believes that this contention will have to be determined between the company and the other person. The Council offers the aid of the City in attempting to settle this dispute; however, the company is the owner of the land benefitted and will be looked to for payment of the assessment.
2. As to the claim of the Etter/Epstein interests, this matter has been resolved through contractual agreement and the assessment will be made against the properties involved as originally determined.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION:
1. That there is hereby assessed against each of the properties hereinafter set out the amounts which follow the description of the properties:

2. That as to payment of the assessments and other matters within the Improvement District ST-82, Phases, A, B and C, Ordinance No. 2156 shall, in all particulars, govern.
