ORDINANCE NO. 2278

AN ORDINANCE PROVIDING FOR THE PRACTICAL SAFEGUARDING OF PERSONS AND PROPERTY FROM HAZARDS ARISING FROM THE USE OF ELECTRICITY IN THE CITY OF GRAND JUNCTION, COLORADO, ADOPTING BY REFERENCE THERETO THE NATIONAL ELECTRIC CODE, 1984 EDITION, PROMULGATED BY THE NATIONAL FIRE PROTECTION ASSOCIATION, TOGETHER WITH THE FEE SCHEDULE ADOPTED BY THE STATE OF COLORADO, PURSUANT TO 12-23-117, COLORADO REVISED STATUTES, PROVIDING PENALTIES FOR VIOLATION OF THE CODE AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:

1. Pursuant to the laws of the State of Colorado and the Charter of the City of Grand Junction, Colorado, the National Electric Code, 1984 Edition, including the appendix thereto, published by the National Fire Protection Association, is hereby adopted as the Electric Code of the City of Grand Junction by reference thereto, all to have the same force and effect as though set forth herein in every particular.

2. The fees for services provided under the code shall be the current Inspection Fee Schedule adopted by the State of Colorado under the provisions of 12-23-117, Colorado Revised Statutes.

3. A public hearing on the adoption by reference thereof of the National Electric Code, 1984 Edition, including the appendix thereto, is scheduled in the City-County Auditorium at City Hall in the City of Grand Junction, Colorado, at 7:30 p.m. on the 5th day of March, 1986, and the City Clerk is hereby directed to publish Notice of said public hearing in the manner and style and pursuant to the schedule of such publication prescribed in Colorado Revised Statutes 31-16-201.

4. At least three copies of the National Electric Code, 1984 Edition, together with appendix thereto, all certified to be true copies, shall be on file in the office of the City Clerk of the City of Grand Junction, Colorado, at least fifteen (15) days preceding said hearing and may be inspected by any interested person between the hours of 8:00 a.m. and 5:00 p.m., Monday through Friday.

5. Any violation of the electric code of the City of Grand Junction, Colorado, from and after the effective date thereof shall be punishable by a fine not exceeding three hundred dollars ($300.00) or imprisonment for a term not exceeding ninety (90) days, or by both such fine and imprisonment.

6. Any and all sections or parts of sections of the Code of Ordinances of the City of Grand Junction, Colorado, as amended, in conflict or inconsistent herewith, are hereby repealed.

7. This Ordinance shall become Section 11-26 of the Code of Ordinances of the City of Grand Junction.
