ORDINANCE NO. 2281

AN ORDINANCE ADOPTING BY REFERENCE THERETO THE UNIFORM SWIMMING POOL, SPA AND HOT TUB CODE OF THE INTERNATIONAL ASSOCIATION OF PLUMBING AND MECHANICAL OFFICIALS, PROVIDING PENALTIES FOR VIOLATION OF THE CODE AND REPEALING ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREWITH.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION, COLORADO:

1. Pursuant to the laws of the State of Colorado and the Charter of the City of Grand Junction, Colorado, the Uniform Swimming Pool, Spa and Hot Tub Code, 1985 Edition, including the appendix thereto, published by the International Association of Plumbing and Mechanical Officials, 5032 Alhambra Avenue, Los Angeles, California 90032, is hereby adopted as the Swimming Pool, Spa and Hot Tub Code of the City of Grand Junction by reference thereto, all to have the same force and effect as though set forth herein in every particular.

2. A public hearing on the adoption by reference thereto of the Uniform Swimming Pool, Spa and Hot Tub Code, 1985 Edition, including the appendix thereto, is scheduled in the City-County Auditorium at City Hall in the City of Grand Junction, Colorado, at 7:30 p.m. on the 5th day of March, 1986, and the City Clerk is hereby directed to publish Notice of said public hearing in the manner and style and pursuant to the schedule of such publication prescribed in Colorado Revised Statutes 31-16-201.

3. At least three copies of the Uniform Swimming Pool, Spa and Hot Tub Code, 1985, Edition, together with appendix thereto, all certified to be true copies, shall be on file in the office of the City Clerk of the City of Grand Junction, Colorado, at least fifteen (15) days preceding said hearing and may be inspected by any interested person between the hours of 8:00 a.m. and 5:00 p.m., Monday through Friday.

4. Any violation of the swimming pool, spa and hot tub code of the City of Grand Junction, Colorado, from and after the effective date thereof shall be punishable by a fine not exceeding three hundred dollars ($300.00) or imprisonment for a term not exceeding ninety (90) days, or by both such fine and imprisonment.

5. Any and all sections or parts of sections of the Code of Ordinances of the City of Grand Junction, Colorado, as amended, in conflict or inconsistent therewith, are hereby repealed.

6. This Ordinance shall become Section 7-2 of the Code of Ordinances of the City of Grand Junction.

I HEREBY CERTIFY that the foregoing ordinance, being Ordinance No. 2281, was introduced, read, and ordered published by the City Council of the City of Grand Junction, Colorado, at a regular meeting of said body held on the 5th day of February, 1986, and that the same was published in The Daily Sentinel, a newspaper published and in general circulation in said City, at least ten days before its final passage.
