ORDINANCE NO. 2314

AN ORDINANCE VACATING A ROAD RIGHT-OF-WAY IN THE CITY OF GRAND JUNCTION.

WHEREAS, the right-of-way hereinafter described has been petitioned for vacation; and

WHEREAS, such vacation has been approved by the Planning Commission and would not be detrimental to the inhabitants of the City of Grand Junction;

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION:

That the right-of-way more particularly described as follows:

A parcel of land located in part of the SW4 of the SE4, Sec 2, T1S, R1W, Ute Meridian, also being a part of Lot 2, Bennett Sub, City of Grand Junction, County of Mesa, State of Colorado, being more particularly described as follows: Commencing at the SE Cor of the SW4 of the SE4 of said Sec 2; thence S 90 deg. 00 min. 00 sec. W along the S li of the SW4 of the SE4 of said Sec 2 a distance of 133.52 ft; thence N 00 deg. 00 min. 00 sec. E, 40.00 ft to the True Point of Beginning; thence continuing N 00 deg. 00 min. 00 sec. E along the E li of said Bennett Sub 10.00 ft; thence N 90 deg. 00 min. 00 sec. W along the S li of Lot 2, Bennett Sub 132.82 ft to a point on the Westerly right-of-way li for 26 3/4 Road; thence S 62 deg. 18 min. 57 sec. W, 21.52 ft; thence S 90 deg. 00 min. 00 sec. W, 113.76 ft to the True Point of Beginning,

be and the same is hereby vacated, subject to an easement for existing utilities.

PASSED and ADOPTED this 3rd day of December, 1986.
