ORDINANCE NO. 2335
ABOLISHING THE ELECTRICAL CODE BOARD OF APPEALS, REFERRING THOSE APPEALS TO THE STATE ELECTRICAL BOARD; COMBINING THE PLUMBING CODE BOARD OF APPEALS AND THE MECHANICAL CODE BOARD OF APPEALS WITH THE UNIFORM BUILDING CODE BOARD OF APPEALS AND EXPANDING THAT BOARD
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION:
1. The Uniform Electrical Code, which is a part of Chapter 11 of the Code of Ordinances of the City of Grand Junction, is amended by the addition of a Section 90-5.5 reading:
"90-5.5. Appeals. The Electrical Code Board of Appeals is hereby abolished. All appeals arising from the Electrical Code shall be determined by the State Electrical Board."
2. Section 20-14 of the Uniform Plumbing Code, a part of Chapter 21 of the Code of Ordinances of the City of Grand Junction is amended to read:
"20-14. Board of Appeals. THE UNIFORM BUILDING CODE BOARD OF APPEALS shall act as a Board of Appeals in making a correct determination of any appeal arising from actions of the Administrative Authority. Appeals shall be made in writing and the appellant may appear in person before the Board or be represented by an attorney and may introduce evidence to support his claims. Appeals shall be heard at reasonable times at the convenience of the Board but not later than 30 days after receipt thereof. The appellant shall cause to be made at his own expense any tests or research required by the board to substantiate his claims."
3. Section 203 of the Uniform Mechanical Code, a part of Chapter 18.25 of the Code of Ordinances of the City of Grand Junction, is amended to read:
"Section 203. Board of Appeals. THE UNIFORM BUILDING CODE BOARD OF APPEALS SHALL determine the suitability of alternate materials and methods of construction and provide for reasonable interpretations of this code AND SHALL CONSIST of members who are qualified by experience and training to pass upon matters pertaining to mechanical design, construction and maintenance and the public health aspects of mechanical systems and who are not employees of the jurisdiction. The building official shall be an ex officio member of and shall act as secretary to said board. The Board of Appeals shall be appointed by the governing body and shall hold office at its pleasure. The board shall adopt rules of procedure for conducting its business and shall render all decisions and findings in writing to the appellant with a duplicate copy to the building official."
4. Section 204 of the Uniform Building Code, a part of Chapter 7 of the Code of Ordinances of the City of Grand Junction, is amended to read:
"Section 204. Board of Appeals. THE UNIFORM PLUMBING CODE SHALL determine the suitability of alternate materials and methods of construction and provide for reasonable interpretations of this code AND SHALL CONSIST of members who are qualified by experience and training to pass upon matters pertaining to building construction and who are not employees of this jurisdiction. The building official shall be an ex officio member of and shall act as secretary to said board. The Board of Appeals shall be appointed by the governing body and shall hold office at its pleasure. The board shall adopt rules of procedure for conducting its business and shall render all decisions and findings in writing to the appellant with a duplicate copy to the building official."
