ORDINANCE NO. 2363
CONCERNING PERSONS WHO HAD NOT ATTAINED THE AGE OF 18 PRIOR TO JULY 30, 1987, BEING IN BARS, LOUNGES OR CARD ROOMS, BEING PERMITTED TO DRINK BEER IN THE PUBLIC PARKS, AND ACTIVITIES CONCERNING SUCH PERSONS WHICH MAY BE A PUBLIC NUISANCE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GRAND JUNCTION:
1. That Section 19-3(a) of Chapter 19 of the Code of Ordinances of the City of Grand Junction be amended to read:
"(a) Prohibited. No person under TWENTY-ONE YEARS OF AGE, EXCEPT A PERSON WHO HAS ATTAINED the age of eighteen (18) years PRIOR TO JULY 30, 1987, shall at any time frequent, attend or be found in any bar or lounge portion of a premises licensed to sell beer or malt, vinous or spirituous liquors by the drink (for the purposes of this section the bar or lounge portion being defined as that area of the licensed premises in which the principal activities are the preparation and consumption of alcoholic beverages) or in any commercial establishment having card tables therein or used in connection therewith."
2. That Section 19-29 of Chapter 19 of said Code be amended to read:
"Section 19-29. Drinking of alcoholic beverages prohibited in certain places.
It shall be unlawful for any person to drink malt, vinous or spirituous liquor in the city in any public street, road, highway, alley or public way which is either publicly owned or privately owned and used by the public except a person WHO IS TWENTY-ONE YEARS OF AGE OR A PERSON WHO HAS ATTAINED THE AGE OF eighteen (18) years PRIOR TO JULY 30, 1987, may drink 3.2 percent beer on the grassed areas of a public park unless otherwise prohibited by appropriate notice, the fact that a person is in or upon a motor vehicle at the time of such drinking shall not be a defense in prosecution under this section; provided, however, that such restrictions shall not apply when such public place is a part of the premises designated under a valid license issued pursuant to the Colorado Beer Code."
3. That Section 19-66(13) of Chapter 19 of said Code be amended to read:
"(13) Encouragement of illegal activities: Any public or private place or premises which encourages professional gambling, unlawful use of drugs, unlawful sale or distribution of drugs, furnishing or selling intoxicating liquor to minors, furnishing or selling fermented malt beverages to persons under TWENTY-ONE YEARS OF AGE, EXCEPT PERSONS WHO HAVE ATTAINED the age of (18) PRIOR TO JULY 30, 1987, solicitation for prosecution, or trafficking in stolen property.
